Health and Safety in the workplace is primarily regulated by the Occupational Health and Safety Act, Act 85 of 1993.

The Act requires the Employer to provide and maintain a healthy and safe working environment that is without risk to Employees.

Employees have the obligation as well to reasonably guard their own health and safety, and other persons in the workplace.

The Employer has the right to discipline an Employee who commits unsafe acts that may negatively impact or endanger other Employees.

Employers are encouraged to design and implement Health and Safety Policies that suit their business needs and environment.

DOMESTIC WORKERS

- In terms of the South African law, a domestic worker is someone who performs domestic work in a private household, this includes gardeners, drivers, and those who care for children, the elderly, sick, frail, or the disabled persons.

- Domestic workers are entitled to be paid a minimum wage by the Department of Employment and Labour.

- Domestic workers are also covered by the Constitution and the Labour Laws of the country.

- A domestic worker that works more than 24 hours a month, need to be registered and contribute for Unemployment Insurance Fund (UIF).

- The moment you hire a domestic worker you become a domestic employer with significant legal responsibilities.

- Non-compliance can lead to severe penalties and legal implications.

- Domestic employment cannot be terminated without any valid reasons or without adhering to proper procedures.
