Any person who is 16 years or older can make a valid Will in terms of the laws of South Africa, provided that he/she is mentally capable of doing so.

A Valid Customary Marriage may only be dissolved by an Order of Court. This means that our Law requires customary marriages to be terminated through Formal Divorce Proceedings.

Therefore simply “walking away” from your Customary husband or wife does not result in a Divorce. You are presumed to still be married to that particular person.

Most importantly - Failure to register a customary Marriage DOES NOT automatically cancel out the existence or validity of that marriage.
