IMPORTANT!

When transferring property from a trust, it's essential that the conveyancer not only examines the trust deed thoroughly, but also checks the will of any deceased person - usually the founder or a trustee - who held testamentary rights or reservations under the trust deed.

Why? Because such rights may impact the validity or timing of the transfer.

Overlooking these provisions can result in the appointment of unauthorised trustees, premature or invalid vesting, or unlawful benefit allocations—any of which may render a transfer invalid or delay the transaction significantly.

NEWSFLASH:

On 6 May 2025 the Constitutional Court handed down judgment in an application for confirmation of an order of constitutional invalidity granted by the Supreme Court of Appeal regarding the constitutional validity of section 6(1)(a) of the South African Citizenship Act 88 of 1995.

The impugned provision causes South African citizens to lose their citizenship automatically if they voluntarily acquire citizenship in another country, unless they have prior permission from the Minister of Home Affairs to retain their citizenship. At the heart of the issue before this Court is the right to citizenship under section 20 of the Constitution.

There is no conceivable purpose nor rational connection why a South African should automatically lose their citizenship by acquiring the citizenship of another country, particularly with the increasing cross-border migration of people.

If you were told you lost your SA citizenship — you may never have lost it at all.

This is major victory for expats wanting to return, invest, or reconnect with home.

When a loved one passes away, the type of death—natural or unnatural—can impact how the estate is handled and how quickly progress can or can't be made in winding up the estate.

A natural death allows the estate process to begin promptly with a death certificate.

An unnatural death (such as an accident or su***de) requires an inquest by the police and possibly a post-mortem, which can delay the issuing of the death certificate—and with it, the estate administration process.

Unfortunately, obtaining the death certificate isn't where it ends - attending to the administration of a deceased estate with an unnatural death requires constant expert knowledge and a unique strategic approach, throughout.

Understanding these differences from the outset and how it'll impact the estate administration in a practical sense, can help you prepare and avoid unnecessary stress during an already incredibly difficult time.
