On the 21 February 2025 we, Thato B Kgapola Attorneys, were at Nebo Refional Court and involved I a divorce matter.

We were on record for the defendant who is indigent and from the grass roots level. She and her husband became estranged and separated around January 2024 after they were married for more than 10 years.

In reply to our counter claim the Plaintiff through his attorneys of record claim for forfeiture and more specifically that the defendant must forfeit the Plaintiff benefits held by Samancor Procident Fund .

We were successful in representing our client in that the Plaintiff successfully failed to meet the three requirements for forfeiture of matrimonial benefits.

In essence the claim for forfeiture was dismissed and equal division of the joint estate was one of the terms of the order.

Our client was accused number 2 in a criminal matter and him and co-accused charged with Murder and state further alleged that they acted in common purpose.

The provisions of of section 51(2) were invoked. In essence client and co-accused if convicted they were facing a minimum sentence of 15 years direct imprisonment.

Upon perusal of the docket contents we realised that the deceased contacted a bacteria (hospital acquired bacteria).

As a direct result the bacteria lead to septicaemia and during the course of his stay in ICU he had a septic shock and later he unfortunately died.

The doctor, who was one of the experts who treated the deceased, was called to testify on behalf of our client and his testimony was that septic shock leads to multi organ failure.

The witness for the defence could not testify as to what caused the death of the deceased either being the initial assault or him contacting a hospital acquired bacteria.

The matter was then on the roll today at Groblersdal Regional Court and our client was acquitted with murder and convicted with assault with intent to do grievous bodily harm.

The matter Is remanded for presentation of correctional supervision report after the presiding officer has reinstated his bail.
