WHO PAYS TRANSFER COSTS? AND HOW IS IT CALCULATED?

In a standard sale, the purchaser usually pays the costs of transfer. This will include:-

Attorney fees = based on the purchase price, calculated in accordance with the prescribed fee
schedule published by the Legal Practice Council.

Deeds Office fees = Also based on purchase price, using the official tariffs as published in the
Government Gazette.

Transfer Duty = Calculated using SARS’s sliding scales, depending on the purchase price.

CAN YOU SKIP THE WATER COMPLIANCE CERTIFICATE WHEN SELLING PROPERTY?

Sellers, beware! If your property falls within the City of Cape Town, you can’t contract out of the water compliance certificate, even if the buyer agrees to waive it.

Under the City of Cape Town’s 2010 Water By-Law, a seller must provide a water compliance certificate from a qualified plumber before transfer. This certificate confirms that:

• The plumbing complies with building regulations
• There are no leaks or defects
• The water meter works
• No stormwater is entering the sewer system

Skipping this? Think again. Non-compliance is a criminal offence and you could face a fine, up to 5 years in prison, or both.

Legal Speak Made Easy

“Objective” v “Subjective”
You’ll come across these terms most often in civil claims, employment disputes, criminal cases, contracts (including property sale agreements) and constitutional matters. But what do they mean? When our law requires an objective approach, courts assess facts, logical arguments, and impersonal standards, uninfluenced by personal beliefs. But when courts apply a subjective test, they consider an individual’s actual thoughts, beliefs, interpretations or intentions.
For example, if you are suing someone for damages and trying to prove negligence, the court will ask what a reasonable person would have done, or not done, to avoid harming you (an objective, impersonal standard), rather than whether the other person actually intended to cause you harm (a subjective, personal standard).

“Objektief’ versus “Subjektief”.
Jy sal hierdie terme teëkom in siviele eise, arbeidsgeskille, strafsake, kontrakte (insluitend in ooreenkomste waar eiendom verkoop word) en in grondwetlike aangeleenthede. Wat beteken dit? Wanneer ons reg 'n objektiewe benadering vereis, beoordeel die hof die feite, logiese argumente en onpersoonlike standaarde. Hier is geen ruimte vir persoonlike sienings of oortuigings nie. Wanneer die hof 'n subjektiewe benadering volg, neem dit wel die individu se werklike gedagtes, oortuigings, interpretasies of bedoelings in ag.
Byvoorbeeld, wanneer jy iemand vir skadevergoeding dagvaar en nalatigheid moet bewys, sal die hof probeer vasstel wat 'n redelike persoon onder die omstandighede sou gedoen het, of nie sou gedoen het nie, om te verhoed dat jy skade gely het of beseer is. Dit is 'n objektiewe, onpersoonlike toets, eerder as om te probeer vasstel of die ander persoon die bedoeling gehad het om jou skade aan te doen; wat 'n subjektiewe, persoonlike toets is.
