Capital Gains Tax (CGT)

It is the amount of tax you’ll owe on the sale of investments and/or investment properties. The amount of tax you will pay is based on the growth of the investment.

There are a lot of differences and regulations surrounding when, if and how much you might owe in capital gains. Here we will look at the capital gains on assets held in your personal name.

The first thing to look at is your biggest asset – your home, or “primary residence”, as we often refer to it. Your primary residence has a R2 million exclusion on capital gains – which means the first R2 million of capital gain is excluded from tax. However, for this exclusion, the following must be true:
* The property was your primary residence (the owner occupied the property)
* You owned the property for at least 2 – 5 years
* You did not receive any rental on the property
* You did not exclude gains from another residential sale during the same time.

It is important to keep a clear record of all improvements made to your property in case SARS does request this proof.

EXAMPLE:
You bought a home in 1990 for R1 000 000. In 2020 you sold your home for R4 500 000. You made improvements to the value of R1 000 000 in those 10 years. The agent commission on the sale is R45 000. Your CGT will be calculated as follows:
Selling price R4 500 000
Less price bought R1 000 000
Less improvements R1 000 000
Less agent commission R 45 000
Total R2 455 000
Less exclusion R2 000 000
Total subject to tax R 455 000
Less annual CGT excl R 40 000
Total subject to CGT R 415 000
