Legal Update: Protection Against Multiple FIRs for the Same Offense
We are pleased to share a significant procedural victory from the Lahore High Court regarding the principle of Double Jeopardy and the illegality of registering multiple FIRs for a single occurrence.
Overview
In Writ Petition No. 28825-2026 (Abdul Rehman, etc. vs. Ex-officio Justice of Peace/A.S.J, etc.), our principal, Rana Muhammad Jahanzaib, represented the petitioners. The case challenged an order dated 07.05.2026, which directed the S.H.O. to record a new statement and proceed with a second FIR despite a first FIR already being registered regarding the matter.
Law & Legal Points.
As detailed in the attached order, the following legal protections were invoked:
* Section 154 Cr.P.C.: The original order sought to direct the S.H.O. to record a statement under this section for a second time.
Section 22-A/22-B Cr.P.C.: The petition challenged the misuse of the Justice of Peace's powers to direct multiple registrations for the same offense.
Existing Jurisdiction: It was argued that the matter already falls within the domain of the , where F.I.R No. 1 of 2026 has already been registered.
Interim Relief: The Honorable Court has suspended the operation of the impugned order, protecting the petitioner from dual proceedings.
Why This Matters
The law is clear: once an FIR is registered for an alleged offense, subsequent FIRs for the same incident are prohibited to prevent legal harassment and ensure a fair trial.
