If You Ever Get Arrested, Here’s What You Must Know

Most people never expect to get arrested until it happens. It’s stressful, overwhelming, confusing, and often time very intimidating. However, knowing your rights can make a huge difference in how you handle the situation.

Here’s what you should remember:

1️⃣ Ask why you’re being arrested
You have the right to know the reason for your arrest. Politely ask the officer, “Why am I being arrested?” If they cannot give you a reason, the arrest may not be valid under the law.

2️⃣ Ask about the warrant
You can also ask whether the arrest is made with or without a warrant. Under Malaysia’s Criminal Procedure Code (CPC), some offences require a warrant usually for less serious offences. Meanwhile, serious offences like robbery, drug trafficking, or murder the police can arrest without a warrant. So, asking politely about the warrant helps you understand the nature of the accusation and whether the proper procedure is being followed.

3️⃣ You have the right to remain silent
You don’t have to answer questions except to identify yourself. If you’re unsure what to say, it’s completely legal to stay silent until you’ve spoken to a lawyer.

4️⃣ You can contact someone or a lawyer
You have the right to call a family member, friend, or lawyer. Let someone know where you are and what’s happening, it helps ensure your rights are protected.

5️⃣ Police detention has a time limit
The police can only detain you for up to 24 hours for investigation. If they want to keep you longer, they must obtain a remand order from the court.

⚖️ Final Tip
Staying calm and knowing your rights doesn’t mean you’re being difficult, it means you understand the law.

Everyone deserves fair treatment, no matter the situation.
