Bombay HC states that CBI has conducted a fair, impartial probe and Jiah Khan's mother Rabia Khan insisting it was murder case is delaying the trial.Jiah’s mother Rabia Khan gave testimony to the special CBI court in Mumbai and said that Sooraj Pancholi verbally and physically abused her late daughter🗞️

Following that💯 reports surfaced that a psychologist had submitted a report to the CBI court that in his interview with Sooraj, where he had to evaluate information from the actor, it was incomplete and fabricated because Sooraj allegedly didn't cooperate. But now the latest reports suggest that Rabia was trying to procrastinate and delay the trial by insisting that it was a homicide.

The Bombay High Court has dismissed a petition filed by Rabia Khan seeking a fresh probe in the Jiah Khan case preferably by the FBI, the domestic intelligence and security service of the United States. The case is presently probed by the Central Bureau of Investigation which has charged actor Sooraj Pancholi, Jiah’s boyfriend, for abetting her su***de on June 3, 2013🗞️

Rabia has been claiming that her daughter was murdered. Reportedly, the bench of judges carried out by the CBI from all possible angles stated that it was a case of su***de. "Repeated insistence of the petitioner to procure a finding from the Court that death of the victim, in this case, was homicidal and not suicidal is a clear indication of procrastinating the trial," the court said.

The entire approach of Rabia Khan appears to procure an order from this Court, without facing trial, that the death of the victim was homicidal and not suicidal. This kind of approach appears to circumvent the due process of law, the HC said🗞️

The Bombay HC checking unit won't be notified of Kunal Kamra's challenge to IT rules until July 5 🗞️

The Union government told the Bombay High Court on Thursday that it will not notify till July 5, 2023 a fact checking unit to identify fake news against the government on social media under the recently amended Information Technology Rules. A division bench of Justices Gautam Patel and Neela Gokhale accepted the statement and said since the amended rules would be inoperable in the absence of a fact checking unit, no urgent hearing was required on stay of the rules as sought by stand-up comic Kunal Kamra 💯

Kamra's counsel Darius Khambata insisted the court hear the matter for interim relief on Thursday itself and argued that the rules would continue to have a chilling effect irrespective of whether the fact checking unit was notified or not. “The rules, as it currently stands, are sterile or inoperable without this fact checking unit or committee.

Whether once the unit is notified it would have a retrospective effect or not is something that needs to be seen at that stage,” the high court said 💫 On April 6, the Union government promulgated certain amendments to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, including a provision of a fact check unit to identify fake or false or misleading online content related to the government. Kamra, in his petition, claimed the new rules could potentially lead to his content being arbitrarily blocked or his social media accounts being suspended or deactivated, thus harming him professionally. He has sought that the court declare the amended rules as unconstitutional and give a direction to the government to restrain from acting against any individual under the rules💯

The Union government in its affidavit filed in court last week reiterated that the "role of the fact check unit is restricted to any business of the central government, which may include information about policies, programmes, notifications, rules, regulations, implementation thereof, etc".

"The fact check unit may only identify fake or false or misleading information and not any opinion, satire or artistic impression. Therefore, the aim of the government regarding the introduction of the impugned provision is explicitly clear and suffers from no purported arbitrariness or unreasonableness as alleged by the petitioner (Kamra)," the Centre's affidavit had said 💯

5 years later, Same-sex marriage: Arguments on sexual orientation may be raised in future 🌟 on Thursday, the Central government argued that allowing unrestricted personal autonomy in sexual orientation may be used to challenge laws that forbid in**st. Solicitor General Tushar Mehta, appearing for the Centre, told the bench that in**st is not uncommon in the world but prohibited all over. 💫

During the arguments, Mehta said he will show from the Special Marriage Act that it is perhaps not an option for the court to not look into the personal laws. While hearing arguments on same-sex marriage on April 18, the apex court had made clear that it will not go into the personal laws governing marriages while deciding the pleas and asked the lawyers involved to argue on the Special Marriage. Section 2(b) of the 1954 law which says two persons are said to be related to each other by full blood when they are descended from a common ancestor by the same wife and by half blood when they are descended from a common ancestor but by different wives.

During the hearing, the CJI observed, Mr. solicitor, therefore, looking at the conspectus of these provisions, perhaps we can conceptualize your arguments by saying that reading the provisions of the Special Marriage Act and, if the court were to make an effort as the petitioners say to reinterpret the provisions, there would be three major problems.

Third, it would involve reinterpretation of personal laws because there are segments of the Special Marriage Act which specifically contain a reference to the personal law.

The Delhi High Court on Monday sought response of the Union Government on a public interest litigation seeking linking of property documents with Aadhaar.

The court was hearing the PIL moved by BJP leader and Advocate Ashwini Upadhyay seeking direction on the Union of India and Delhi government to take steps to link movable and immovable property documents of citizens with their Aadhaar number to "curb corruption, black money and benami transaction".

In the plea, Upadhyay has submitted that the Right to Life guaranteed under Article 21 of Constitution of India cannot be secured and that the “golden goals” set out in the Preamble cannot be achieved without curbing the corruption and benami transaction. “Therefore, it is the duty of the State to take apposite steps to curb corruption and seize the benami properties,” the plea states.

"As on today, every citizen of our country has an Aadhaar number, asking them to link it to their property documents is a better option. The main advantage to this strategy is that the tax authorities will get details about 'legal owners' immediately," the plea states.

It adds that once the Aadhaar linkage happens, tax authorities can approach the “legal owners” and it can be treated as benami property if the “legal owners” are unaware or deny knowledge of the ownership. Even if the legal owner takes onus and claims that it is his property, he needs to show the ownership.
