Improvements to the 188A application process
New streamlined application form
The NSW Department of Industry is pleased to announce a streamlined application process for NSW nomination for the Business Innovation and Investor visa (subclass 188A) - Business Innovation Stream.
Effective 1 March 2016, applicants seeking NSW nomination for the 188A visa are able to apply with a new easy-to-use application form that replaces the “Business Commitment” document previously required with the NSW nomination application. The new form has straightforward questions that ask the applicant to provide an overview of their proposed business intentions in NSW.
The new form does not remove the requirement for 188A nominees to set up a business in Sydney and / or Regional NSW, but removes some of the unnecessary paperwork in the early stages of the application process. The new form offers NSW nominees the time and flexibility to prepare a business plan closer to the time that they intend to migrate to NSW and once they have a better understanding of the state’s business and industry landscape. Applicants who are granted a visa and migrate to NSW are required to update the NSW Department of Industry of their business activity within 12 months after they have moved to NSW.
The new approach delivers on our promise of providing a great customer experience by ensuring that the NSW nomination process is simple and easy for applicants at the nomination stage. By implementing this change to our nomination process for the 188A visa, the Department aims to attract and welcome more business migrants who boost economic activity and create jobs in NSW.

To be nominated by NSW for the Business Innovation (188A) visa, applicants need to submit an application that demonstrates that they meet NSW nomination requirements. This includes that they:
• have a successful business career
• have sufficient net personal and business assets
• are committed to business activity that contributes to investment and job creation in NSW
• agree to update NSW Department of Industry on their business activity in NSW
• meet DIBP requirements for the 188A visa.
Pathway to permanent residency (Subclass 888A)
All 188A visa holders who go on to seek NSW nomination for a Business Innovation and Investor (Permanent) (subclass 888A) visa will need to show that they meet NSW nomination 888A nomination requirements, including demonstrating that they have established a business in NSW that meets NSW’s investment and job creation requirements.

Other recent improvements
The streamlining of the 188A application process follows a number of recent enhancements to the NSW migration program, making it simpler and easier for our potential nominees:
• Shorter processing times for Business Talent (Permanent) visa (subclass 132): From 29 January 2016, NSW reduced the processing times for this visa subclass from 12 weeks to 8 weeks. We will allocate a relationship officer to your case within 24 business hours of receiving your application. For complete applications, we will advise of an outcome within eight weeks.
• Removal of “excluded industry sectors” criteria: From 1 January 2016, NSW removed the "excluded industry sectors" criteria from NSW business visa nomination requirements. The 'excluded industry sector' criteria restricted the type of businesses that business migrants could set up in Sydney. (The requirement did not apply to businesses in Regional NSW.) These changes are aimed at making NSW a more competitive place to do business, by providing wider opportunities for migrants to start and grow a business in the state.
