[English below] CÁC TRƯỜNG HỢP CÓ THỂ CHUYỂN ĐỔI MỤC ĐÍCH VISA TẠI VIỆT NAM

Chuyển đổi mục đích thị thực là vấn đề được nhiều người nước ngoài đang sinh sống, làm việc, đầu tư hoặc có thân nhân tại Việt Nam quan tâm.

Về nguyên tắc, thị thực Việt Nam không được tự do chuyển đổi mục đích. Người nước ngoài nhập cảnh với mục đích nào thì cần sử dụng thị thực phù hợp với mục đích đó. Nếu muốn thay đổi mục đích lưu trú, thông thường người nước ngoài phải xuất cảnh và xin thị thực mới theo đúng diện phù hợp.

Ngày 17/7/2026, Chính phủ ban hành Nghị định 286/2026/NĐ-CP, có hiệu lực từ 15/9/2026, thay thế Nghị định 64/2015/NĐ-CP.

Nghị định mới không bổ sung thủ tục hành chính mới đối với người nước ngoài, mà tập trung tăng cường phối hợp giữa các bộ, ngành và địa phương, đồng thời đẩy mạnh kết nối, chia sẻ dữ liệu trong công tác quản lý.

🔻 05 điểm đáng chú ý:

1️⃣. Phối hợp quản lý chặt chẽ
Các cơ quan nhà nước sẽ tăng cường phối hợp trong công tác quản lý nhập cảnh, xuất cảnh, quá cảnh, cư trú và hoạt động của người nước ngoài tại Việt Nam.

2️⃣. Đẩy mạnh chia sẻ dữ liệu
Thông tin về thị thực, giấy tờ xuất nhập cảnh, cư trú và các thủ tục liên quan sẽ được kết nối, chia sẻ giữa các cơ quan có thẩm quyền nhằm nâng cao hiệu quả quản lý.

3️⃣. Quản lý đồng bộ hơn
Các cơ quan sẽ phối hợp quản lý thông tin về nhập cảnh, cư trú và hoạt động của người nước ngoài theo chức năng, nhiệm vụ được giao.

4️⃣. Tăng cường kiểm tra, xử lý vi phạm
Việc xác minh, kiểm tra và xử lý các hành vi vi phạm liên quan đến nhập cảnh, xuất cảnh, quá cảnh và cư trú sẽ được phối hợp chặt chẽ hơn.

5️⃣. Làm rõ trách nhiệm của từng cơ quan
UBND cấp tỉnh và các bộ, ngành có trách nhiệm xây dựng cơ chế phối hợp, xác định đầu mối trao đổi thông tin để việc quản lý được thống nhất và kịp thời.

📌 Doanh nghiệp và người nước ngoài cần lưu ý

Mặc dù không phát sinh thêm thủ tục mới, việc chia sẻ dữ liệu giữa các cơ quan sẽ chặt chẽ hơn. Vì vậy, doanh nghiệp và người nước ngoài nên:

✅ Cung cấp thông tin, hồ sơ chính xác, đầy đủ.
✅ Sử dụng visa, thẻ tạm trú đúng mục đích.
✅ Theo dõi thời hạn cư trú và thực hiện khai báo tạm trú đúng quy định.

EFFECTIVE FROM 15 SEPTEMBER 2026: KEY UPDATES TO VIETNAM’S FOREIGN NATIONAL MANAGEMENT MECHANISM

On 17 July 2026, the Vietnamese Government issued Decree No. 286/2026/ND-CP, which will take effect on 15 September 2026 and replace Decree No. 64/2015/ND-CP.

The new Decree does not introduce any additional administrative procedures for foreign nationals. Instead, it focuses on strengthening coordination among ministries, government agencies and local authorities, while promoting greater connectivity and data sharing in the management of foreign nationals in Vietnam.

1. Closer coordination among authorities
Government authorities will strengthen their coordination in managing the entry, exit, transit, residence and activities of foreign nationals in Vietnam.
2. Enhanced data sharing
Information relating to visas, entry and exit documents, residence and other relevant procedures will be connected and shared among competent authorities to improve management efficiency.
3. A more consistent management approach
Authorities will coordinate the management of information concerning the entry, residence and activities of foreign nationals in accordance with their assigned functions and responsibilities.
4. Stronger inspection and enforcement
The verification, inspection and handling of violations relating to entry, exit, transit and residence will be conducted through closer coordination among the relevant authorities.
5. Clearer responsibilities for each authority
Provincial People’s Committees, ministries and government agencies are required to establish coordination mechanisms and designate focal points for information exchange, ensuring timely and consistent management.

📌 What businesses and foreign nationals should note

Although no new procedures are being introduced, data sharing among government authorities will become more comprehensive and closely coordinated. Businesses and foreign nationals should therefore:

✅ Ensure that all information and supporting documents are accurate and complete.
✅ Use visas and temporary residence cards strictly for their intended purposes.
✅ Monitor permitted periods of stay and complete temporary residence declarations in accordance with the regulations.
✅ Fully comply with sponsorship and invitation responsibilities and cooperate with competent authorities when required.

Sau khi quy định mới về lý lịch tư pháp được áp dụng từ 01/7/2026, cá nhân và doanh nghiệp cần lưu ý một số điểm thay đổi quan trọng sau:

🔹 1. Cơ sở dữ liệu được quản lý tập trung, thống nhất
Cơ sở dữ liệu lý lịch tư pháp được quản lý tập trung, thống nhất do Bộ Công an chủ trì quản lý, vận hành, bảo vệ và lưu trữ. Việc quản lý theo hướng tập trung giúp tăng khả năng kết nối, chia sẻ dữ liệu với các cơ sở dữ liệu quốc gia khác, hỗ trợ quá trình xử lý hồ sơ thuận tiện và đồng bộ hơn.

🔹 2. Trực tuyến là hình thức mặc định với người có định danh điện tử mức độ 2
Cá nhân đã có tài khoản định danh điện tử mức độ 2 sẽ thực hiện yêu cầu cấp Phiếu lý lịch tư pháp trực tuyến thông qua ứng dụng VNeID hoặc Cổng Dịch vụ công quốc gia.

Đối với người nước ngoài hoặc người chưa có tài khoản định danh điện tử, hồ sơ có thể được nộp trực tiếp hoặc qua dịch vụ bưu chính theo quy định.

🔹 3. Phiếu điện tử và Phiếu giấy đều có giá trị sử dụng
Phiếu lý lịch tư pháp có thể được cấp dưới dạng bản điện tử hoặc bản giấy. Khi cần thiết, thông tin lý lịch tư pháp hiển thị trên VNeID cũng có thể được sử dụng theo quy định.

🔹 4. Thời gian xử lý được rút ngắn
Thời hạn cấp Phiếu lý lịch tư pháp được rút ngắn còn 05 ngày làm việc, thay vì 10 ngày làm việc như trước đây.
Trường hợp cần xác minh thêm, thời gian giải quyết tối đa là 15 ngày.
Bên cạnh đó, cơ quan tiến hành tố tụng sẽ khai thác thông tin thông qua chia sẻ dữ liệu trên hệ thống dùng chung và không yêu cầu cá nhân phải cung cấp riêng lẻ.

🔹 5. Thuận tiện hơn trong một số trường hợp ủy quyền
Công dân Việt Nam và người nước ngoài đã hoặc đang cư trú tại Việt Nam từ đủ 16 tuổi trở lên có quyền yêu cầu cấp Phiếu của mình. Một số trường hợp có thể ủy quyền cho người khác thực hiện thủ tục theo quy định.

JUDICIAL RECORD CERTIFICATE APPLICATIONS: 5 KEY UPDATES TO NOTE AFTER 1 JULY 2026

After the new regulations on judicial records took effect on 1 July 2026, individuals and businesses should take note of several important changes when preparing relevant documents:

🔹 1. Centralized and unified database management
The judicial record database is now centrally and consistently managed, operated, protected, and stored by the Ministry of Public Security. This centralized approach helps improve data connectivity and sharing with other national databases, supporting a more streamlined and consistent application process.

🔹 2. Online application is the default method for individuals with a Level 2 electronic identification account
Individuals who have a Level 2 electronic identification account will submit their request for a Judicial Record Certificate online through the VNeID app or the National Public Service Portal.
For foreign nationals or individuals who do not have an electronic identification account, applications may be submitted in person or by post in accordance with regulations.

🔹 3. Electronic and paper certificates are both valid
A Judicial Record Certificate may be issued in either electronic or paper form. Where applicable, judicial record information displayed on VNeID may also be used in nationals or individuals who do not have an electronic identification account may submit their applications in person in accordance with regulations.

🔹 4. Shorter processing time
The processing time for a Judicial Record Certificate has been reduced to 05 working days, instead of 10 working days as previously applied.
If further verification is required, the maximum processing time is 15 days.
In addition, competent procedural authorities will access judicial record information through data sharing on the common national system and will not require individuals to provide it separately.

🔹 5. More convenient authorization in certain cases
Vietnamese citizens and foreign nationals who are or have been residing in Vietnam, aged 16 or older, have the right to request their own Judicial Record Certificate. In certain cases, applicants may authorize another person to complete the procedure on their behalf in accordance with regulations.
