Great to be working with Commonwealth Second Amendment (Comm2A) and Gun Owners' Action League on this important issue. The Legislature has made clear that an LTC application should be processed in 40 days (a bit too long in my opinion). Yet police departments across the state are thumbing their nose at the mandatory time standards and doing so with impunity.

Current reported wait times at some departments: Boston: 6-8 months; Attleboro: 8 months; Worcester: 8 months; New Bedford: unclear since they are scheduling appointments in 2026.

These unreasonable delays are a product of an institution that scoffs at the exercise of a fundamental constitutional right. Extensive licensing delays have been flagged as unconstitutional by the Supreme Court and the SJC. It is time for the SJC to put the state and police departments on notice that delaying access to a constitutional right will not be tolerated.

“I still think there is a problem with the discretionary nature of suitability,” said Jason Guida, a Second Amendment lawyer representing a Boston gun owner currently challenging the license law in Superior Court.

The SJC landed a significant blow to the pending constitutional challenges seeking to invalidate the "suitable person" standard in Massachusetts.

"The defendant's Second Amendment challenge ... fails because 'shall issue' licensing schemes, the purpose of which is to restrict possession of fi****ms by demonstrably dangerous persons, are consistent with this nation's historical tradition of firearm regulation". CW v. Marquis, SJC No. 13562.

While the Marquis and Donnell cases were brought by non-residents, the Court analyzed the the entire fi****ms licensing scheme. The Court determined that the "suitable person" standard was sufficiently crafted to withstand a facial challenge under Bruen and, under current law, an LTC "shall issue" to an applicant who is not a prohibited person or deemed unsuitable.

Bottom line - Massachusetts police chiefs are still empowered to deny LTC applications based on any dangerous conduct or behavior, even if that conduct or behavior does not result in a criminal conviction.

The decision came after the Supreme Judicial Court heard a pair of cases involving New Hampshire gun owners who were charged for unlawfully possessing fi****ms in Massachusetts without proper permits.
