Tips for the Signer During a Real Estate Closing ~

We book 40 minutes per appointment. Your signing will usually take between 20-30 minutes, even with chatting and questions. If you would like to read the packet in its entirety/have an attorney/family or friend read, please reach out to your loan officer and ask for a full copy of the closing packet to review prior to close. During your closing,

we will review in detail your Closing Disclosure first and then give a brief explanation of each document as they are presented for signature. IDENTIFICATION:
Please make sure that you have a COPY of your ID to send back in the signed packet. Even if you have provided a copy of your ID previously, we are required to send a copy back in the packet as well. If you cannot make a copy prior to close, please text a picture to Deb Barclay at 517-974-8753 ASAP. Your packet is sealed and dropped after your signing, which does not allow time for the Signing Agent to go back to the office and print a copy.

***Acceptable forms of primary ID in the State of Michigan***To properly identify an individual you must have one of the following pieces of ID. This must be current and not expired. If you do not have one of these pieces of ID, or if the ID is expired (even by one day), the signing legally cannot take place. (MCL 55.285[6][c]

US & Foreign Passport
US Military ID
Permanent Reside Card (aka Green Card) issued by the US Citizenship & Immigration Service


ACCOUNTING:
If you are receiving funds back at close and would like them deposited into an account, please have that information available and ready. Sometimes a check is the only option for disbursement, however if the option is available for a wire transfer/deposit and you would like to exercise that option, please have those numbers ready. Name of Bank
Account Number
Routing Number

Additionally, sometimes the lender will include an auto-pay form to have your payments automatically deducted from an account. If you would like to utilize this option, please have your accounting information ready:

SIDE NOTES:
* If you are closing in the evening, make sure your porch light is on during darker hours. It can be very difficult to not only see the house numbers, but also navigating outside in an unfamiliar area.

* Here at TKS Mobile Notary, we personally love animals and have no allergies. However, you know your pet better then we do. Please put them in another room if they are not friendly, otherwise, we are happy to visit with furry/sometimes non-furry babies.

I would say the Senior Expo was a great success today 💜 I handed out probably 250-300 bags, and not even all people in attendance took one.

It was a great opportunity to not only talk with people attending, but other vendors as well.

Thank goodness for my Aunt Sandy who stopped in to check out the expo (or check in on me, I’m not sure which 😅) As I was drowning trying to fill bags with handouts on notarial and apostille information (I’ll upload the packet to my website at TKSMobileNotary.com), as well as other helpful resources and the little freebies that everyone loves, she stepped right up and filled bags, chatted with people, and had a great time all around 💜

Please raise your right hand; “You do solely swear”… If a notary is not swearing you in, they are doing it WRONG.

These past few months I have been working mainly directly with title companies, which has put more loan officers and real estate agents in my closings. (Previously the majority of my closings were refinances where loan officers did not attend, and real estate agents were not a part of the process).

I have had a few dozen different individuals look at me side eye, start to laugh, look me directly in the eye, make various comments, and even stop the signing looking bewildered.

“I have never seen this before and I have been a loan officer for 40 years”
“I have bought and sold multiple houses and never done this”
“What is this”
“This is new, it must be something you do.” My reply was no, it has been around as long as I have been a notary, 30 years.
“Are you making this up because I have never seen this before”
“Am I getting married again”
“Am I back in the service”

And, I actually had a loan officer tell a signer that this was something “this title company does and this is not normal”.

In each instance, I simply smiled and told whoever is questioning me that I will show them the specific wording as to why I am swearing them in.

Let me state it plainly, for every notary, if the notary block is a Jurat, the signer needs to be sworn in. It is not optional; it is the law.

When you meet with a notary, it is okay to ask to see the notarial black.

In the state of MI, a notary journal is not required for wet signed documents, however, if a RON (remote online notarization) is performed, a journal and video recording is required to be maintained.

The best practice is to always maintain a journal that contains:

📌date/time
📌fee paid
📌location where the notarization took place
📌if a property is involved in the transaction the address of the property
📌name of the signer
📌type of identification used to verify the signer including DOB, issue/expiration date and number on the identification
📌title of document notarized
📌type of notarization performed (jurat, acknowledgment or witness)
📌any additional notes to help a notary recall the transaction

⚖️ Three tools that keep your home out of probate. Same goal, different availability, different price tags.

A TOD deed is the cheapest and simplest option. You sign it, get it notarized, and record it with the county. Total cost is typically under $500. Available in 32 states plus D.C. The property transfers outright to your beneficiary at death. No conditions, no timing, no restrictions on how they use it.

A Lady Bird deed works the same way in practice but is only recognized in five states: Florida, Michigan, Texas, Vermont, and West Virginia. Texas and West Virginia also allow standard TOD deeds, so the Lady Bird deed is a true "only option" in Florida, Michigan, and Vermont. In Florida and Michigan, Lady Bird deeds may offer an additional benefit: protection from Medicaid estate recovery that a standard TOD deed does not provide.

A revocable living trust works in all 50 states and covers all assets you transfer into it, not just one property. The setup cost is higher ($1,500 to $3,000+ with an attorney), and you need to retitle assets into the trust for it to work. The trade-off is flexibility. A trust lets you add conditions: age restrictions, staggered distributions, protections for a beneficiary with creditor issues or a spending problem.

None of the three provides creditor protection during your lifetime. None reduces estate taxes. A revocable trust is not an asset protection trust. The only thing all three do is avoid the probate process.

If your estate is a house and a few accounts, a TOD deed (or Lady Bird deed in FL/MI/VT) may be all you need. If you have multiple properties, blended family dynamics, or minor beneficiaries, a trust is worth the cost.
