AUTO ACCIDENTS -
MOST COMMON CAUSES OF CAR ACCIDENTS IN TEXAS
There are many different ways in which an auto accident can occur. The most common causes of an accident include:
Distracted driving
Speeding
Drunk driving
Reckless driving
Weather conditions
Design defects
If you have been injured in a car, motorcycle, truck, ATV, boat or pedestrian-related accident, I can help. Drunk Driver Accide
nts -
Unlike most other types of motor vehicle crashes, those caused by drunk drivers typically involve gross negligence and a crime committed by the drunk driver. A local district attorney or prosecutor may get involved to file criminal charges against the drunk driver, but you, the victim, will not receive compensation for your injuries unless you hire an experienced law firm to help you with your civil case. Trucking Accidents and Commercial Vehicle Accidents -
Because trucks are heavier and larger than cars, accidents involving trucks tend to cause more severe injuries and have a higher fatality rate. Many trucking accidents can be avoided if truck drivers and responsible companies act with a minimum standard of care. When they do not, DK Law, PLLC helps you prove those companies’ and individuals’ negligence and liability in cases involving:
Driver fatigue
Aggressive driving behavior
DUI/DWI
Unsafe road conditions, such as snow, ice, rain or fog
Unlicensed or untrained drivers
Truck rollovers
Oversized trucks
Overloaded trucks
Tire blowouts
Brake failure
Poor truck maintenance
Mechanical defects
Tractor-trailers and 18-wheelers
Motorcycle Accidents -
Motorcycle accidents are not the same as car or truck accidents or other personal injury cases. The structure and handling of a bike creates unique characteristics and circumstances exclusive to motorcycle cases. DK Law, PLLC is well versed in the particulars of representing injured motorcyclists, taking into account the:
Higher likelihood of injury in motorcycle accidents, even in seemingly minor collisions
Lack of injury safeguards that are typically built into other types of motor vehicles
Failure of motorists to detect or yield to motorcyclists
Seriousness of impact when motorists tailgate or cut off a cyclist
Effect of unsafe road conditions, such as potholes or uneven surfaces, on motorcyclists
Wrongful Death -
While dealing with the death of a loved one is always difficult, doing so can become infinitely more complex when you try to set aside your devastation to deal with the legal aspects of filing a wrongful death lawsuit. DK Law, PLLC possesses a thorough understanding of Texas wrongful death law. I represent families in lawsuits involving:
Auto accidents
Truck accidents
Slips and falls
Traumatic brain injuries
Workplace accidents
Motorcycle accidents
Defective products
Lack of proper security
Mesothelioma
Medical malpractice
Birth injuries
Nursing home abuse and neglect
Aviation accidents
Assault
Murder
Hair Salon Burns:
Common technician mistakes that cause these burns include:
Dilution — If a stylist does not properly measure the chemicals for the hair dye or bleach, the solution could be too highly concentrated, putting the client at risk for a chemical burn on their scalp. Amount of exposure — These products should only be on the hair for a certain amount of time, and an experienced technician should know the time limit. If chemical substances stay on the hair and scalp for longer than the appropriate length of time, severe damage can occur. Coverage — There are certain areas of the skin that should not be exposed during these treatments, and if those areas are not properly covered, they will be susceptible to serious injuries. Wrongful Termination:
I represent Texas workers in wrongful termination cases involving:
Discrimination. A firing cannot be based on an employee’s membership in a legally protected group. I am a strong advocate in matters involving discriminatory firings that arise from a worker’s age, s*x, race, religion, ethnicity, disability or other characteristics outlined in federal statutes. I can also advise you of claims that might exist under state law. Employees should never be punished for reporting illegal conduct or dangerous conditions at their workplace. If you’re a whistleblower who has been fired,
I will investigate if any connection exists between your report and your termination. I can uncover the true motivation for a dismissal even if your employer tries to invent another reason for your firing. Whether an agreement covers an individual employee or a whole group of workers, companies must honor the provisions relating to termination. I will conduct a diligent review of the relevant contract and take action against your former employer if they failed to abide by the terms of the agreement when releasing you. Sexual Harassment
I treat all accusations of s*xual misconduct seriously. Quid pro quo: The first and most overt type of s*xual harassment exists when a person’s employment or career advancement actually depends upon submission to a superior’s s*xual overtures. This quid pro quo (this for that) exchange can be explicitly stated or merely implied by the overall circumstances. Hostile work environment: This type of s*xual harassment is found in workplaces where unwanted s*xual conduct unreasonably interferes with an individual’s work performance or creates an intimidating, hostile or offensive working environment. When a worker hates being on the job because of the s*xual conduct she must see, hear or suffer, she may very well have a case for s*xual harassment. The unwelcome question: The sticking point for all s*xual harassment claims is that the conduct must be unwelcome. Office flirtations and romances, even between a worker and a supervisor, are not harassment when they are fully consensual. Therefore, it is important for a victim to take reasonable steps to establish his or her objection to the behavior. Same-s*x s*xual harassment: Sexual harassment does not have to be between members of opposite s*x. Cases of same-s*x harassment are prevalent, and it is not necessary to prove a homos*xual orientation in the harasser.
