What Assets Can Be Divided in a California Divorce?

Many people think only bank account balances are divided. In reality, California’s community property rules cover a wide range of assets. Any property or income acquired during the marriage is generally considered community property — unless one spouse proves it is separate.

Here’s a breakdown of common assets that may be divided:

Bank Accounts
Money earned during the marriage is community property, even if the account is only in one spouse’s name.
Investment Accounts & Equity Compensation
• Investment accounts: Brokerage accounts holding stocks, ETFs, mutual funds, or other securities funded during the marriage may be community property.
• Equity compensation: RSUs, stock options, and ESPP earned during the marriage may also have a community share. Division depends on grant date, vesting schedule, and the amount earned during the marriage.

Retirement Accounts
Retirement benefits earned during the marriage — including 401(k), IRA, CalPERS, or CalSTRS — are typically community property. Some plans require a QDRO to divide.

Real Estate Purchased During the Marriage
A home purchased during the marriage may be community property, even if only one spouse’s name is on the title.

Vehicles Purchased During the Marriage
Cars or other vehicles bought during the marriage may be divisible regardless of whose name is on the registration.

Credit Card Rewards & Airline Miles
Points or miles earned during the marriage may be community property.

Money in Digital Accounts
Funds in PayPal, Venmo, or CashApp may also be treated as community property.

Other Income Earned During the Marriage
This includes wages, business income, bonuses, commissions, gambling winnings, or lottery prizes.

加州離婚流程不難,但文件真的很多
第一次發這樣的內容,想用輕鬆的方式分享一些我對加州離婚流程的理解,也聊聊自己多年來在這個領域工作的經驗。
我不是律師,也不提供法律意見。但我長期在灣區從事家庭法文書工作,目前是加州登記的 Legal Document Assistant(LDA)。
我的工作不只是把表格填對,而是協助當事人在整個流程中,把每個容易出錯的環節處理好,讓事情少出錯、不繞路。
很多華人朋友走到這一步已經很不容易,但真正把人卡住的,往往不是法律本身,而是程序:
表格太多、規則太細,一不小心就被退件,甚至影響案件下一步的推進。
有時看到當事人自己做文件,因為錯過期限、格式錯誤或附件不全,耽誤了整個進度;更令人遺憾的是,有些人在不了解的情況下放棄了可以主張的權利,結果後來不得不花大筆律師費來補救。
這些年來,我從文書層面協助處理過離婚流程中的各種細節:準備和遞交法院文件、安排各項截止日期、財產與收入披露、motion 草稿撰寫、subpoena 文件協助與送達、出庭資料整理,還有 discovery 前的程序準備等等。(所有協助都在加州法律允許的範圍內,僅限文書與流程,不涉及法律意見,也不代表當事人出面。)
所以我常說:這些離婚表格,我真的一張張、一份份,在工作中仔細做過。每一份文件、每一個遞交程序,我都會盡可能把關好,不讓當事人多跑冤枉路。

明明有钱,却被藏起来?离婚时如何调查对方资产
很多人离婚时最怕的一件事,不是分不到钱,而是——
明明有钱,却被对方藏了。
那些转走的存款、突然空掉的账户、神秘消失的投资,像一场精心布置的“消失术”。
“我不是想查他的钱,我只是想知道,这段婚姻里,到底还有多少真话。”
离婚最伤人的往往不是结束,而是发现原来对方早已暗暗做了准备。
但你并不是没有力量。
法律早就为你准备了三把钥匙,只要你会用,就能让真相无处可藏。
不是为了争,而是为了让自己安心。💔

⚖️ 一、财产披露
这是离婚程序中法律强制要求的步骤。
在递交离婚申请/回复后60天内,双方都必须完成初步财产披露
✅ 优点
• 每个离婚案都必须走这一步,不需额外申请。
⚠️ 缺点
• 对方需签署“在伪证罪下真实填写(sign under penalty of perjury)”,但真实度取决于诚信与法律意识。
• 有些人会漏填或故意隐瞒资产,仅靠这一项还不够。

🔍 二、Discovery(取证程序)
这是专业人士最常用、也是最有威力的一步。
它可以让你正式要求对方提供资料、文件,甚至回答特定问题。
常见形式:
A. Request for Production of Documents
• 要求对方提供文件,例如:
• 最近5–7年的银行账单(包括国内外账户)
• 税表、工资单、投资账户
• 可一次提出几十个甚至上百个要求
B. Form Interrogatories – Family Law
• 法院统一格式的问答表格,快速了解对方财务情况
C. Special Interrogatories
• 自由问答式,可针对特定怀疑发问
• 💡 示例:
“请说明您在提出离婚后,是否有将任何金额转给亲友?如有,请列出金额、日期及接收人。”
D. Request for Admission
• 让对方承认或否认事实
• 💡 示例:
“请承认您在2024年6月购买了一辆特斯拉。”
“请承认您自2024年1月起停止支付法院命令的配偶赡养费。”
• 可作为庭审证据使用
📌 注意
• Special Interrogatories 和 Request for Admission 一般不超过35个问题,超出需提交“Declaration for Additional Discovery”。
📈 优缺点
✅ 优点
• 对方拒绝回答,可 file Motion to Compel 请求法官强制执行
• 若仍无视法庭命令,构成 contempt(藐视法庭)
• 每份 Discovery 答复需有 Verification 签名页,若撒谎,其信用在法官面前会崩塌
⚠️ 缺点
• 格式、语言、截止日期有严格的法律要求
• 我见过有人用 AI 帮忙写文件,结果很多错误,被罚 $5,000
👉 所以,请务必确保文件 专业、准确

🏦 三、Subpoena(传票调取资料)
当你知道对方资产所在,可向第三方发传票,例如:
• 银行(Bank of America、Chase 等)
• 雇主
• 投资机构
✅ 优点
• 资料精准、真实
⚠️ 缺点
• 程序复杂、成本高,但在关键案件中非常值得
财产披露、Discovery、Subpoena,这几种方法都是法律赋予的工具,目的是帮助你查明真实财产、保障自身权益。合理运用它们,就能在离婚过程中依法保护自己,确保决策建立在真实信息基础上。

低收入一方离婚,能做什么?
常有人说:“付出必有回报。”可婚姻呢?好像从来不是一条公平跑道。
如果你为了家庭牺牲了事业、青春,全心照顾孩子和另一半,让对方无后顾之忧……等到离婚时,你真的会得到对方感恩的心,给你大笔钱,让你从此衣食无忧吗?
说实话,我在做婚姻法这些年,好像还没见过。
我见得最多的,是低收入一方因为怕没钱而迟迟不敢离婚:
• 担心离婚后生活无法自理
• 担心没钱争孩子抚养权
• 担心法官会因自己没钱把判孩子给对方
• 担心自己没钱和对方争
你没有错。离婚,往往是人性最低点的考验。
但你也很幸运——加州法律对低收入一方保护很好。那我们可以做什么呢?

1️⃣ 要 Spousal Support(配偶赡养费)
无论婚姻长短,都可以向对方请求。
虽然加州法官的目标是让低收入一方最终可以自立,但在判定赡养费时,会参考你离婚前的生活水平,保证你不会突然“从天堂掉到地狱”。
2️⃣ 要 Child Support(孩子抚养费)
按孩子和双方父母相处的时间比例来算。
记住,加州法官在孩子问题上永远以“孩子最大利益”为优先。没钱没关系,你只要争取应得的抚养费就好。
3️⃣ 财产分割
婚姻期间对方的收入,包括工资、股票、RSU、401(k)等等,都是可以要求平分的。
别以为“那钱不是我赚的”,no no no,你也有权利。
4️⃣ 律师费问题
担心没钱打官司?加州有 need-based 律师费制度。
法官会确保双方都有平等机会聘请律师,实践一万,几万,十几万都有,我甚至见过极端案例,高收入一方被判付上百万律师费。

3️⃣ 律师 + LDA 组合
• 无争议离婚:LDA 足够
• 有争议或后续出现争议:可用组合策略
方式:
• 前期 LDA,后期律师全权代理
• 有限代理 / 咨询律师:
o 有限代理(Limited Scope):律师只处理你认为复杂或关键的环节,例如出庭、重要文件,其余普通文件和流程由你自己或 LDA 完成
o 咨询律师(Consulting Attorney):你自己处理大部分流程,但遇到法律问题或需要策略建议时,可以向律师咨询或请律师处理特定问题
这样既节省成本,又能在关键环节得到专业保障。

4️⃣ 全程律师代理
预算充足可直接找律师
• 优点:几乎不用操心任何流程,所有文件、协议、出庭都由专业律师全权处理 ✅
• 缺点:费用高昂 💸,可能比 LDA 或组合方案贵好几倍

California Divorce: Can You Rely on ChatGPT?
AI is powerful, and lawyers are expensive—so many people wonder if they can use ChatGPT to prepare their own divorce documents. Is it feasible? What have your experiences been with ChatGPT? Feel free to share in the comments. Here’s my perspective: ChatGPT can help, but it depends on how you use it.
✅ How ChatGPT Can Assist You
1. Answer simple questions
Example: “How long is the waiting period for divorce in California?”
⚠️ Only suitable for very basic questions. Always check the legal source and confirm on official websites. More complex questions are beyond its reliable use.
2. English grammar helper
It can help edit emails or documents for grammar, but it cannot organize facts or analyze legal content.
3. Legal dictionary
Not sure what a legal term means? ChatGPT can provide quick explanations.
4. Tips for better results
Clearly describe your background and needs before giving it tasks—it will be more useful.
5. Emotional support
Divorce can be stressful, and chatting with AI can help reduce anxiety.
❌ What ChatGPT Cannot Do
1. Professional legal analysis
Legal documents aren’t just a collection of facts—they require strategy. A knowledgeable professional can present the same facts in a way that is persuasive and legally advantageous.
🔹 Analogy: It’s like cooking: the ingredients are the same, but the technique, seasoning, and presentation make the dish completely different.
2. Overconfidence and potential misinformation
ChatGPT often presents information very confidently, which may make you believe it’s correct. In reality, it can be wrong. Pointing out one mistake often only gets a generic response like “good catch.”
I’ve seen clients follow AI guidance, misunderstand the process, submit incorrect documents, and get fined by the court.
3. Cannot perform professional legal research or drafting
It cannot reliably search statutes or case law. In practice, some lawyers have been sanctioned for using ChatGPT to draft documents citing nonexistent cases.
4. Cannot organize facts strategically
Legal documents require combining statutes, case law, and litigation strategy—AI cannot do this.
💡 Summary
ChatGPT can be a helpful assistant for checking basic procedures, editing English grammar, looking up vocabulary, and easing stress.
Professional legal documents and strategy still require a qualified professional.
For those on a limited budget, using an LDA or paralegal service is a good option. Costs are lower than hiring a lawyer, and they can help you organize documents professionally and reduce errors and risks.
Remember: In divorce proceedings, spending money to avoid mistakes usually costs less than correcting them later.

“I don’t even know which bank our money is in.”
You’re not alone — this is more common than you might think. When one spouse manages all the finances, the other can feel completely unprepared once the process begins.
Divorce isn’t just a single event — it’s a step-by-step process that takes planning and organization.
Here’s a simple checklist to help you stay informed and prepared 👇

1️⃣ Get a Clear Picture of Your Finances
• Gather bank statements, investment and retirement account information (401k, IRA), property records, and details of any debts.
Even if you don’t have copies, try to find out which banks or institutions hold the accounts.
• Collect available income information such as pay stubs, W-2s, 1099s, and tax returns.
• If you have concerns about missing or hidden information, save any notes or documents you already have.
Why this matters:
Being aware of your overall financial picture helps you stay organized and informed as you move through the paperwork process.
