A family calls after losing someone, and they say, "We thought Mom had everything set up. She had a will. She had accounts."

🔍 In most states, when one parent dies, the law presumes the surviving parent gets custody - even if the parents were separated, estranged, or in the middle of a custody dispute.

That presumption can be challenged. But doing so requires a court proceeding, evidence, and time. And while all of that is being sorted out, your child may be in legal limbo.

A recent Michigan appellate court case is a real example of how this plays out. The surviving parent hadn't seen the child in over two years. The case went through multiple courts. The child had a chronic medical condition that needed ongoing care during all of it.
