Many people ask me “Do I have to ‘include’ this in the bankruptcy?” or “We don’t have to tell them about do we?”
The short answer is: Yes, you do. Period. End of Statement.
Bankruptcy Fraud can be considered concealing or not disclosing any assets that are part of the bankruptcy estate, or any debts that have been incurred as of the date of filing. I like to tell my clients there is no such word as ‘include’ in bankruptcy. It’s either all in or all out.

When the bankruptcy attorney asks you for information, it may seem intrusive, ponderous, and labor intensive. Realize though that your attorney has your best interest in mind, and that the last thing the attorney wants for you is to end up like Mr. Dykstra.

Former All-Star outfielder Lenny Dykstra was sentenced Monday to 6½ months in prison for hiding baseball gloves and other heirlooms from his playing days that were supposed to be part of his bankruptcy filing, capping a tumultuous year of legal woes.

I subscribe to a daily newsletter from the Accounts Receivable Management group, which is an association and trade newsletter for the consumer debt collection industry. It is always enlightening to see what the "other side" is saying about debts. Here, they are announcing what our friends at the National Consumer Law Center (NCLC) are doing regarding student loans.

The Money Tree Inc., a Georgia-based provider of small consumer loans, and several of its subsidiaries have filed for bankruptcy protection, citing the economy and customers’ inability to repay loans.
