One of the most fascinating (and eye-opening) medical malpractice cases we’ve worked on highlights why attention to detail is everything.

During a deposition, we equipped our attorney-client with targeted medical questions to ask a defendant — a nurse. What unfolded was unnerving, but in our favor.

First, the defendant admitted they had never reviewed the hospital policy on required assessments for a specific type of patient. Let that sink in. The policy existed to ensure safe, standardized care, yet it wasn’t followed — and the consequences were devastating.

But then came the kicker: through additional questioning, the nurse confessed to back-charting several hours after the event. In just three minutes, they entered eight identical notes covering over four hours of patient care. And if that wasn’t enough, they made changes to the documentation the following day. 🚩🚩

These revelations raised serious questions about the integrity of the medical record and the quality of care provided. They also served as a sobering reminder of why compliance with hospital policies and accurate documentation aren’t just “check-the-box” tasks—they’re lifelines for patients.

Our patient began hemorrhaging…

I was attending a routine delivery as a resource nurse in labor and delivery and almost immediately after the baby was out, the placenta delivered, and things turned critical.

At that moment, I could see a stream of blood draining into the collection bag and we knew to minimize blood loss, our response had to be precise.

I immediately called for help and delegated tasks: a second IV for fluid replacement, vital signs every 5 minutes, obtaining specific medications to have at the bedside ready for the physician’s orders, and bringing the hemorrhage cart to the bedside.

Having clear roles, communication, and a strategic process we routinely practice allowed us to expeditiously stabilize her bleeding and avoid surgical intervention. After some additional monitoring, she safely transferred to postpartum with her newborn.

Had we stumbled through the hemorrhage, her story could have taken a less fortunate turn.

Nurses rely on protocols, experience, and teamwork to respond swiftly, a perspective we bring to every birth injury or obstetric case we review. Understanding these high-stakes moments firsthand allows us to provide valuable insights, especially when evaluating the standard of care.

What’s standing between patients and their safety? Communication breakdowns - and this starts with routine bedside handoff.

When one provider transfers responsibility of care to another, the off going provider must communicate pertinent medical and treatment information for safety and continuity of care.

In nursing, conducting this handoff at the bedside allows the patient to participate. It also allows both nurses to visually evaluate status, vitals, catheters, lines, tubes, and any recent changes in medication or treatment plan.

Data has shown that conducting handoff at the bedside reduces safety events such as falls, medication errors, and communication errors (staff to staff, and patient/family to staff).

This also allows the off going nurse to introduce the oncoming nurse and instill confidence and trust in their new provider as well as establish any questions, concerns, or goals for the next shift.
