USCIS announced that Temporary Protected Status (TPS) applicants who are eligible nationals of Burma, Somalia, Syria, Venezuela or Yemen, or individuals without nationality who last habitually resided in one of those countries, can now file Form I-821, Application for Temporary Protected Status, online, if they are applying for TPS for the first time.
“USCIS is using innovation and technology to meet the needs of applicants, petitioners and employees,” said USCIS Acting Director Tracy L. Renaud. “Regardless of the paper or electronic format of an application or petition, USCIS is committed to ensuring a secure and efficient process for all.” At this time, the option to file Form I-821 online is only available to initial TPS applicants from these five countries.

USCIS announced that employers may file H-2B petitions for returning workers under the FY 2021 H-2B supplemental visa temporary final rule.
A petitioner must file a new Form I-129, Petition for a Nonimmigrant Worker, together with an approved and valid temporary labor certification that states an employment start date for the second half of the fiscal year, and attest that these non-citizens will be returning workers.
USCIS will accept petitions for returning workers until Sept. 15, 2021, or until the remainder of the cap is reached, whichever occurs first. The allocation of 6,000 visas to workers from the Northern Triangle is part of the Biden-Harris administration’s broader efforts to expand legal pathways for protection and opportunity for nationals of El Salvador, Guatemala, and Honduras.

Happy Juneteenth!🇺🇸
Freedom finally came on June 19, 1865, when 2,000 Union troops arrived in Galveston Bay, Texas. The army announced that the more than 250,000 enslaved black people in the state were free by executive decree.
Today, Juneteenth is a federal holiday commemorating the end of slavery in the United States! With Biden’s signature, Juneteenth is the first holiday to be approved since Martin Luther King Jr. Day, which was established in 1983.

The Department of Homeland Security said The Biden administration will make an additional 22,000 seasonal guest-worker visas. The additional visas will become available ahead of the summer season.
The visas are in addition to the 66,000 H-2B visas the government makes available each year to seasonal employers, including landscapers, fisheries, resorts and county fairs, which look to add staff for their busy seasons.
Six thousand of those additional visas will be set aside for applicants from the Northern Triangle of Central America; Guatemala, El Salvador and Honduras, which together are sending the largest number of migrant families and children to the U.S. border seeking asylum.

F-1 Students Seeking Optional Practical Training Can Now File Form I-765 Online.
USCIS announced that F-1 students seeking optional practical training (OPT) can now file Form I-765, Application for Employment Authorization, online if they are filing under one of these categories:
(c)(3)(A) – Pre-Completion OPT;
(c)(3)(B) – Post-Completion OPT; and
(c)(3)(C) – 24-Month Extension of OPT for science, technology, engineering and mathematics (STEM) students.
“USCIS remains committed to maximizing our online filing capabilities,” said Senior Official Performing the Duties of USCIS Director Tracy Renaud. “The I-765 online filing option allows eligible students to file forms online in a more user-friendly fashion and increases efficiencies for adjudicators.” As USCIS continues to transition to paperless operations, the agency will work to expand online filing for Form I-765 to additional categories.
