1. The H-4 visa is only for the dependent spouse and children of a current H2-A and/ or H2-B visa holder.

2. You may only apply for a H-4 visa if you are legally and currently married to the H2-A and/ or H2-B visa holder.

3. Your length of stay in the United States can not be any longer than that of your spouse who holds the current H2-A and/ or H2-B visa.

4. You MUST be able to provide birth certificates for yourself and your children (if applicable).

5. You MUST obtain a valid Mexican passport.

6. Everyone must have a current Mexican Passport (even children under one years of age).

7. You MUST be able to provide a Wedding Photo Album (album de fotos de boda). You will be present this to the American Consulate at the time of your interview.

8. You MUST be able to provide your Marriage License (certificado de matrimonio/ casamiento/ a.) You will be present this to the American Consulate at the time of your interview.

9. Your spouse's employer must agree to provide you with a copy of your spouse's current and valid H2-A or H2-B visa. You will be present this to the American Consulate at the time of your interview.

10. Your spouse's employer must agree to provide you with a legible copy of the 1-797 B, Notice of Action, Approval Notice (see attached example). You will be present this to the American Consulate at the time of your interview.

11. You may not work in the United States. The H-4 visa is not a work visa.

12. Children under the age of 20 years may also receive a H-4 visa.
