Volk & McElroy, LLP achieved an excess verdict in Hidalgo County in a case involving disputed liability and minimal property damage. The client’s medical history included an emergency room visit following the accident, a two-month gap in treatment, an urgent care visit, and two weeks of chiropractic care. There were no MRIs or X-rays conducted, and no further treatment occurred after September 2022.

Prior to litigation, the defense offered no settlement, maintaining a $0 position, and rejected a reasonable proposal during mediation. Despite the defense’s firm stance, Volk & McElroy, LLP sought the policy limit, asserting the value of the client’s claim.

The case proceeded to trial, which lasted three days. Key testimony was provided by Dr. Jorge Saenz, the owner of the urgent care center where the client received treatment. Dr. Saenz testified in person, providing crucial evidence that supported the client's claims of injury and the necessity of medical care, despite the gaps in treatment and the relatively short duration of chiropractic care.

After deliberation, the jury returned a favorable verdict for the client, awarding a total of $37,731.59, broken down as follows:
$17,731.59 for past medical expenses,
$12,500.00 for past pain and suffering, including mental anguish,
$7,500.00 for past physical impairment.

Additionally, the jury’s award was subject to interest, further enhancing the client’s recovery.

Moreover, prior to trial, a separate defendant settled during mediation for $6,178.00, bringing the total recovery to $43,909.59. This result significantly exceeded the defense's initial pre-litigation position of offering nothing and rejecting a $12,000 mediated settlement proposal.

The case highlights the importance of diligent representation, even in seemingly low-damage cases. Through careful trial preparation, expert testimony, and a strong presentation of the client’s medical history, Volk & McElroy, LLP successfully demonstrated the value of the client’s claims, securing a substantial recovery despite the defense's reluctance to settle and the lack of extensive medical treatment or diagnostics.

This outcome serves as a reminder of the unpredictable nature of litigation and the importance of pursuing a case to trial when necessary to achieve a just result for the client.
