From Oral Argument ➡️ to Appellate Win. ⚖️
We are proud to share a significant appellate victory in the Sixth Circuit during its special sitting in Detroit, where Managing Partner Kali Henderson secured reversal of the district court’s denial of qualified immunity for our jail deputy clients.
The plaintiff argued that jail deputies were deliberately indifferent to an inmate’s medical needs, even though the Jail required he gain medical clearance from the hospital before lodging him, and the plaintiff admitted the inmate returned to the Jail in the same condition he left in, only upon return he had clearance from a doctor.
The Sixth Circuit reversed and granted qualified immunity in our client’s favor, holding that the officers did not violate clearly established law. It emphasized that the circumstances—viewed as they existed at the time, not in hindsight—did not present an “obvious” need for additional medical intervention.
