Instead, your child might end up in the permanent care of a blood relative - even if that relative doesn’t agree to raise your child the way you’d want or honor their own gender identity. 🌈 😥

If you’re in an LGBTQ+ relationship, 🌈you know that family isn’t just about bloodlines - it’s also about your chosen family and the bond and love you share for each other. 💗👪🏿And if you have children, you know that ensuring their well-being and protection is of the utmost importance.

True or False?: Any lawyer will be able to design great planning for my LGBTQ+ family.

FALSE! Many traditional lawyers create cookie-cutter 🍪 plans for their clients (yikes!), which means a large amount of custom estate planning language would be necessary to make those plans effective for an LGBTQ+ family. 🖊️

This approach leaves huge room for error in planning for LGBTQ+ families 👨🏿‍❤️‍💋‍👨🏿 and is more work than many lawyers know how to do or want to do.😔

That’s why it’s so important to work with an attorney who has experience serving LGBTQ+ families and who gets to know your family on a personal level. 👩‍❤️‍👩

Hey, get this! 📣 The law doesn’t assume that you’d want any particular person making decisions for you if you become incapacitated unless you name that person in a Power of Attorney (POA). 👆📜

If you don’t, your family will need to go through a stressful court guardianship procedure to name a decision maker, or a judge might name a complete stranger as your decision maker instead! Yikes! 😫

That’s why it’s vital to name your chosen decision-maker - your Power of Attorney - far in advance. This is especially important if you want any lifestyle choices or beliefs like a special diet 🥑, style of dress 👚, or hormone therapy 💊 to still be carried out if you’re incapacitated.

Even with the legalization of same-sex marriage and increased recognition of LGBTQ+ families, there is still a large gap in estate planning for LGBTQ+ individuals that could leave your loved ones with a big mess. 🤷💔

True or False?: Even though my partner and I have been together for years, my assets won’t automatically pass to her because we aren’t legally married.

TRUE! If you die without a plan in place, your possessions 🧸 and money 💰will pass to your next closest relatives by blood or marriage. If you aren’t legally married to your partner, then your partner will be automatically disinherited in the event of your death, even if you live together. 😱 ⛔

Likewise, if you have children that are unrelated to you that you haven’t formally adopted, those children will not be entitled to receive anything from your estate after you die unless you plan to in advance. That’s why it’s so important to make sure you have a plan that takes care of your family, no matter how the law defines them! 👩‍❤️‍💋‍👩👨🏿‍❤️‍💋‍👨🏿

Question: My sister says she’s happy to take care of my dog if something happens to me. Do I still need to add my dog to my estate plan?

Answer: Yes! Even if someone you know and trust offers to take care of your pet in the event of your incapacity or death, there’s no way to know whether that person will still be available to care for your pet for your pet’s lifetime. They might:

• Live in an apartment or condo that doesn’t allow pets 🚫🐾
• Suffer from an unforeseen illness that makes it difficult to care for your pet🤒
• Have an allergy to your pet you knew nothing about 🤧
• Become so busy with work or family that they just don’t have the time to make a lifelong commitment to your pet’s care 🏃‍♀️💼

Hey there pet parents! You love your furry friend more than anything, right? 🐶🐱 But did you know that leaving them in your Will won't actually protect them if you die or become incapacitated? 😱 I know, crazy, right?

Your pet is considered property under the law, and whoever receives a gift of property through your Will can do whatever they want with it, including your beloved pet. Yikes!
