There are so many important parts to criminal defense work. Not only do we fight to protect the constitutional rights of the accused, and counsel them legally, we end up counseling on many other levels. Often we stand next to someone who feels they have nothing left, that the system is completely stacked against them, and regardless of the outcome of the case their life in many ways is over. Sometimes a good defense attorney is the only one there for the accused—to fight for them on every level possible, and to inspire them to maintain hope or to bring about positive change in their life.

This job is constantly grueling, coming up against opponents who have endless resources, in a system where the accused is seen as just another case on a docket that needs to be moved expeditiously. I am always honored to stand by those who often have no one else there for them when they are at risk of losing their life and liberty.

Big win for our client. After a fun evidentiary hearing with nearly an hour of cross examining an officer who was not very credible, we appeared this week for oral argument. The court held that the seizure of our client, who was charged with a class 3 felony, was unconstitutional. The court ordered suppression of all evidence, leaving no likelihood of conviction. Our client, who was facing significant prison time, will live on as a free man!

Big trial victory. Jonathan was charged with 25 counts including trafficking stolen property, burglary, and theft. He was facing a presumptive stacked sentence at trial of 389.35 years, for about $7,500 of allegedly stolen property. His plea offer was 20 years. He was told in court that if he lost at trial his sentence for at least some of the counts would be stacked. At his age he was facing life in prison. Jonathan hired us after other attorneys did nothing with his case for nearly five years. Jonathan put his life in our hands and at trial we precluded a majority of the state’s evidence. Jonathan walked out of court today as a free man.

While at times I feel completely overwhelmed—moving 90 miles a minute—juggling trial practice, personal life, volunteering, and business development, it is little things like this that remind me why I give up some personal time to help others. The week between Christmas and New Years is a great time to relax but also to get ahead with all of my cases. It is also a nice time to reflect back on the past year and to enjoy what you have. Today I decided to dress casual and take an hour before work to enjoy and support a couple of local business in near my office. I spent the time thinking back on how grateful I am for the clients and families who put their lives in my hands, and how I was fortunate enough to help every single one of them. I am grateful for every expert, witness, and attorney who helped us achieve justice along the way during such an incredibly hard year for so many people. So, whether you are enjoying a week off or are in the office catching up on work, take the time to reflect on the positive things this bleak year has brought you. Maybe get out, safely, and support a local business who may not have had as many positive things to reflect back on. Stay safe and have a happy new year.

Whatever you are celebrating this year do not forget about those less fortunate than you. Those who are sitting in jail awaiting trial, constitutionally presumed innocent, who cannot be with their families because of the cash bail system. I am here seeing an 18 year old client with no prior felony convictions who has a $500,000 bond. Clearly that eviscerates his constitutional right to release. He is not a flight risk and is not a danger to the community. A judge already denied one motion to modify his release conditions based primarily on the nature of the charge. The system needs change. I primarily handle felony criminal defense cases given my model of practice. I do not take more than a certain number of cases so I can effectively represent each of my clients by doing the most thorough investigation to determine how strong our case is for trial and so that I can litigate every single constitutional issue for each client. However, I do take misdemeanor cases if my caseload permits it. I treat my misdemeanor cases the same as my felonies. I investigate and litigate everything I absolutely can to give my clients the best chance of a dismissal or success at trial, or a beneficial resolution short of trial.

We obtained 5 case dismissals, with prejudice, for Pat. He had five prior attorneys and appeared over 40 times for court, without a positive end in sight. He was facing prison mandatory flat time sentences in each case. Based on his age, he was looking at essentially the rest of his life in prison after trial. We filed dozens of motions throughout his cases, we never stopped investigating, and never stopped fighting for him until we got the result he deserved. Pat is an amazing guy and we are so happy he and his family are able to move on with their lives.

After months of nonstop fighting, this is exactly what I needed. It is extremely important to take the time to decompress, no matter what field you are in, but especially if you work in the criminal defense field. We spend so much time battling against the government, battling with judges, battling against injustice, and fighting to protect the lives and constitutional rights of our clients, that it can take a toll mentally. Take the time to reset mentally so you can continue the fight with the same passion, aggressiveness, and determination, for each and every client.

Phoenix PD has rounded people up for either peacefully exercising their first amendment right or simply being in the area of people peacefully exercising their 1st amendment right. They have done so without any particularized probable cause to arrest individuals. They arrested people, had police reports with no information at all regarding the individuals (a clear 6th and 14th amendment issue), then referred to an overall broad report that outlined actions taken by hundreds of people and claimed it supported charges for an individual person not described at all in the report. The broad report reads like a military civilian casualty report, ex: munitions used include pepper balls; CS gas; muzzle bangs; super sock stun bags; 40 mm Ariel and impact rounds.
We live in a police state. We must continue to stand against the oppression, demand action, and demand change. We must not accept the bu****it actions taken by the militarized force—many of which violate our constitutional rights and some of which unjustifiably kill our citizens.
