Can you spot the lie?

1. Law enforcement can search your garbage without a warrant once you place it outside the curtilage of your home for collection.

2. During an interrogation, law enforcement officers may lie about the evidence they have against you.

3. In Georgia, the testimony of a single witness can sometimes be enough to establish a fact at trial—even without physical evidence.

4. Police must read you your Miranda rights immediately upon arrest.

ANSWER: No. 4. Miranda warnings are generally required before a custodial interrogation—not automatically at the moment of arrest.

Did you know it’s legal for law enforcement to lie to you and use deception in investigations, interviews, and interrogations, but it’s illegal to lie to the police?

Here’s the full picture, in Georgia, as in most of the United States:

Law enforcement officers generally may use deception during investigations and interrogations. For example, they may falsely tell a suspect that a witness identified them or that forensic evidence exists. Courts have generally upheld these tactics so long as the deception does not make a confession involuntary under the totality of the circumstances.

On the other hand, it can be a crime for a person to knowingly and willfully make a false statement to law enforcement in certain circumstances. OCGA § 16-10-20 makes it a crime to knowingly and willfully falsify, conceal, or cover up a material fact, or make a false, fictitious, or fraudulent statement or representation, in a matter within the jurisdiction of a state or local government agency. This can apply to statements made to police during an investigation, depending on the facts.

Advice: Stay out of trouble, but if you find yourself in a troublesome situation, invoke your Rights to remain silent and have a lawyer present.

You may have seen posts circulating on Facebook claiming that if you copy and paste a statement saying “I do not give Facebook or Meta permission to use my data for AI,” it somehow protects your information.

As an attorney, I want to clear up the confusion: those posts have no legal effect.

Posting a statement on your timeline does not override the terms of service you agreed to when you created your account. Social media platforms like Facebook operate under user agreements and privacy policies. A copied post or “chain message” does not modify that contract.

These types of posts have been circulating in different forms for years (many of you may remember the “I do not give Facebook permission to use my photos” post from a decade ago). They continue to resurface whenever new technology like AI becomes part of the conversation.

If you’re concerned about how your data is used online, the real options are:
• Review and adjust your privacy settings
• Limit what you post publicly
• Remove content you do not want shared
• Review the platform’s terms and data policies

The bottom line: Copy-and-paste disclaimer posts on social media do not create legal protection.

When it comes to your rights online, it’s always best to rely on accurate legal information—not viral chain posts.

Friends and Family, we’re doing it a fourth year!

I am grateful for the DA’s Office and Roughnecks MC for yet another opportunity to give back and support the joy and happiness of our youth.

We would love to have your donation of an unused/unwrapped toy or monetary donation (checks made to Toys for Tots of Middle Georgia). I can pick up your donations, just send me a message. There will also be boxes located at the DA’s Office (located at the Courthouse in Perry) and the Fringe Salon in Warner Robins.

Toys for Tots is a Marine Corps supported organization which provides toys to children who otherwise would go without during the Holiday season. If you make a monetary donation, that money is used with a discount from the retailer to purchase toys.

Thank you for making the last three events highley successful, let’s go for four!
