A notarization is about more than confirming someone’s identity.
The signer should appear aware of what is happening, be able to communicate their decision, and be signing willingly. A diagnosis, age, illness, or cognitive impairment alone does not automatically mean a notarization cannot take place — what matters is the signer’s awareness and willingness at the time of the notarization.
A notary is not there to diagnose mental capacity. Instead, we observe, communicate directly with the signer, ask simple questions when needed, and use professional judgment before proceeding.
Florida notaries should also refuse when a signer appears intoxicated, sedated, disoriented, coerced, or unable to understand the consequences of signing.
Sometimes the most responsible thing a notary can do is not stamp the document.
Planning ahead can make an important difference, especially when notarization involves an elderly, hospitalized, or medically vulnerable family member.
