A routine vaccine should not cause a life-changing shoulder injury.

Our client, an experienced emergency department nurse, felt intense shoulder pain immediately after receiving an injection. What followed was chronic pain, restricted movement, sleep disruption and ultimately, and inability to return to the emergency nursing career that she loved.

At trial, Casey Dorey and Warren WhiteKnight were able to prove that the vaccine had been administered in the wrong location and that the improper injection caused her shoulder injury. The Court awarded substantial damages for the impact on her health, career, income and daily life.

This case is an important reminder that even routine medical procedures can have serious consequences when they are not performed properly. Proving medical negligence requires careful evidence on both the standard of care and causation.

Last week, in Kingston Ontario, a prisoner escaped from Collins Bay Institution.

This brings up a question of, if an inmate escapes custody and someone gets hurt, who is responsible? The obvious answer may be the person who caused the injury, but legally, there is more to consider.

Last night was a Red Mass. This is a Catholic Mass, held for judges, lawyers, law students and others involved in the justice system.

This mass takes place at the beginning of the court year, to ask for guidance, wisdom and intergrity.

Chris Clifford, Kanon Clifford and Robert Murphy were able to attend last night.

Thank you to all those who came out and made it a wonderful Mass and reception afterwards.

A surgical complication doesn't automatically mean medical malpractice occurred.

Even when surgery is performed appropriately, complications such as infection, bleeding, nerve damage or something else can happen.

The important question is often not simply whether a complication occurred or not, but, how the medical team responded to it.

Was the complication recognized in a reasonable timeframe? Were warning signs investigated? Was appropriate treatment provided? Did the care before, during and after the surgery meet the expected standard?
