Can police search your vehicle without a warrant?

Because vehicles are treated differently under the law than homes, officers may conduct a warrantless vehicle search under certain circumstances. One example is when police have probable cause to believe the vehicle contains evidence of a crime.

Consent can also give officers permission to search. During a traffic stop, you are not required to consent simply because an officer asks.

In this video, we explain the automobile exception, how probable cause can affect a vehicle search, and what your Fourth Amendment rights mean during a traffic stop.

IN PLAIN TERMS: Beyond a Reasonable Doubt

You've probably heard this phrase in movies and courtroom dramas, but what does it actually mean?

"Beyond a reasonable doubt" is the highest burden of proof in our legal system. Before someone can be convicted of a crime, the prosecution must present enough evidence to convince a jury that there is no reasonable doubt about the defendant's guilt.

It doesn't mean proving a case with absolute certainty. It does mean the evidence must leave jurors firmly convinced before they can return a guilty verdict.
That high standard exists because our legal system recognizes the serious consequences of a criminal conviction.

There's nothing quite like game day in Lincoln and oftentimes Husker Saturdays quickly turn into full-day plans. If drinks are part of your plans, make the ride home part of them too.

Designate a driver, schedule a rideshare, or plan to stay somewhere nearby before kickoff. Lincoln gets busy on game weekends, and waiting until the end of the night to figure out how you’re getting home can leave you scrambling.
