📣📣Talkin' Bout it Tuesdays📣📣: HALLOWEEN PARTYYYY!!! But, what is YOUR potential liability for supplying alcohol at a Halloween party? Under Oklahoma's social host law, if people under age 21 are drinking alcohol on private property, the person who provided the location (not necessarily the property owner) can be held criminally liable. If party goers are injured or die, the social host can be punished by up to five years in prison and a $2,500 fine. Plus, the social host does not even have to be present! Even if no one is injured, social hosts can be fined up to $500 for providing alcohol to folks under 21.
Adults-only parties can also result in civil liability, especially if drinks are sold. Oklahoma negligence law is based on the general rule that it is negligent to permit unreasonable risk of harm to others. So serving alcohol to an obviously intoxicated person or permitting an intoxicated person to drive is definitely risky!!
