Our client walked into a courtroom facing a violent felony charge — Assault in the Second Degree — after police alleged he assaulted NYPD officers during an incident in Manhattan.

If convicted, he faced a mandatory minimum of 5 years in prison.

At trial, Partner John Buza maintained that the police were the actual aggressors in the incident and that, despite their testimony to the contrary, no officers sustained injuries.

After hearing the evidence, the jury rejected the DA’s claims and delivered a swift acquittal in our client’s favor.

Our client entered Rikers Island with a long-standing glaucoma condition that required medical treatment. The City denied him the care he needed and, as a result, he went blind.

The City’s response? Claim he was already blind, litigate the case for years, and lowball our Client at every settlement opportunity.

Konta Georges & Buza are proud to announce a major resolution of a years-long and high-profile Construction Law matter involving Omnibuild Construction and its founder, John Mingione, that will result in a misdemeanor for Mr. Mingione and ALL CHARGES DISMISSED against Omnibuild Construction Co.

Omnibuild and Mingione were indicted in 2024 on charges stemming from an alleged $86M Ponzi scheme orchestrated by Nir Meir and HFZ Capital Group. From the beginning, Omnibuild and its employees have stood firm, asserting that they, too, had been victims of the scheme. Nonetheless, the Omnibuild defendants faced numerous serious felony counts that could have shut down the company, and sent Mr. Mingione to jail.

The deal reached with the Manhattan District Attorney’s office last week ensures that Mr. Mingione will end up with a non-financial misdemeanor, bringing meaningful closure to a case that once carried significant felony exposure. Further, the dismissal of charges against Omnibuild will allow the company to move forward with its business intact, protecting the livelihoods of its many employees, and closing the door on years of uncertainty.

We believe this is a just result that reflects the facts, preserves the company’s integrity, and allows all parties to turn the page.
