At ALFA, we believe that difficult cases deserve to be fought with strategy, persistence, and careful legal analysis.
This case is a powerful example of that.
Our client had lived in the United States for nearly three decades when he was detained by ICE because of an old deportation order.
From the beginning, the case presented significant challenges.
A relative in his home country had been murdered by the cartel, and one of the arguments raised was that these changed circumstances supported reopening the case so he could seek protection.
That request was initially denied.
But our team did not stop there.
We continued reviewing the case and raised additional legal arguments, including his nearly 30 years in the United States, his six U.S. citizen children, the significant hardship his removal could cause to his family, and concerns regarding whether he had ever received proper notice of the original immigration hearing.
At one point, ICE was preparing to remove him from the United States.
Our team acted urgently and obtained a stay of removal, preventing the deportation while we continued fighting his case.
Then came the decision we had been hoping for:
THE MOTION TO REOPEN WAS GRANTED.
This is a major victory.
It does not mean the case is over, and it does not guarantee the final outcome. But it gives our client something incredibly important: the opportunity to present his case, his family ties, his fears, and the legal relief available to him before an Immigration Judge.
After nearly three decades in the United States, he now has another opportunity to fight to remain here with his family.
And the battle continues.
Our next goal is to fight for his release from immigration detention so that he can continue pursuing his case outside of custody and hopefully reunite with his family.
This is what persistence can look like in immigration litigation.
A major victory, and an important step forward.
