Today the US Department of Homeland Security published a new rule which will allow certain foreign entrepreneurs to obtain work authorization in the United States for up to 5 years (in two separate 30 month increments). The rule becomes effective July 17, 2017. As some of you already know, the US Government recently announced that the annual H-1B visa cap was reached (which means that the vast majority of new H-1B petitions will not be accepted until April 1, 2017). This is the fourth year in a row that the cap was reached within one week, which means that once again the US Government will conduct a lottery to determine which of the recently submitted H-1B petitions will be reviewed and which will be rejected and returned. Needless to say, it is truly a shame that so many legitimate business opportunities which would benefit the US economy are lost due to grossly outdated immigration quotas

H-1B visa season has arrived. For those that are interested in applying for initial H-1B status, it is strongly recommended to start preparing your application soon, as the completed H-1B petition must be filed with USCIS on April 1, 2016. If the petition is not filed on time, it is extremely likely that the opportunity to apply for an initial H-1B visa will be lost until 2017 (due to the very limited number of available H-1B visas per year).

Registration for the 2017 Diversity Visa Program opens today (October 1) at noon EST and closes on November 3. For those that are seeking a Green Card, this “lottery” program can potentially be an amazing solution (although not everyone is eligible and obviously you have to be fortunate enough to be selected in the lottery).

Registration is free and easy – just go to www.dvlottery.state.gov and complete the form online. The questions on the form are simple but be sure to answer them correctly, as seemingly trivial mistakes (such as listing your marital status incorrectly) will often cause your application to be denied in the future. Good luck to those who register.

On August 24, 2015, USCIS announced that it is shutting down its electronic application system. The last day to start new electronic USCIS forms in the current system is August 30, 2015, and the last day to electronically submit such forms is September 20, 2015. USCIS states that a new, more advanced electronic system will eventually replace the current one, but it is not yet clear when the new system will be launched.
