Lee R. Shubert Attorney with a background in real estate, family law, and litigation prep. I have previously worked in the chambers of the Honorable Lee H.

After growing up in North Carolina and attending Washington & Lee University for undergrad, the University of Richmond School of Law accepted me as a Marshall Scholar. During my law school tenure, I gained experience working at every level of the judicial branch: a juvenile and domestic relations trial court, and both the appellate and supreme court of North Carolina. After graduating, I moved to

New York, where I took and passed both the New York and New Jersey bars. Since that time, I have continued to seek out work and learning opportunities to build upon my education and experience. In particular, I have continued to maintain a focus on family law, while also branching out into real estate law. Elkins at the Kings County Family Court. This is my fourth year of providing litigation preparation support for Residential Mortgage-Backed Securities cases. Additionally, I have recently begun work as a Court Examiner to provide assistance and oversight to the guardians appointed to incapacitated persons by auditing their annual financials. I continue to seek opportunities for growth and experience in the day-to-day practice of family law and real estate law.

A close friend and colleague sent me the following New York Times article regarding the [alleged] abuse of the guardianship process by nursing homes.

The idea that anyone would attempt to take control of an incapacitated person's finances in order to just pay themselves is an absolutely disturbing perversion of the guardianship process. Unfortunately, the numbers cited within the article make it seem like this is not an isolated incident; indeed, it may even be happening more often now.

I understand that these businesses need to get paid to continue operating, but any instances in which a company (or individual) abuses the guardianship process to collect debts rather than guard the incapacitated person should be brought to light and halted by the courts.

A New York State statute to protect the infirm has become a routine tool for nursing homes to ensure bills are paid.

I just finished a class on foreclosure that stated the entire foreclosure process here in New York can drag on for almost 8 years. Looks like it might get even longer with more foreclosures coming down the pike.

U.S. home foreclosures jumped 12 percent last month, but the sharp divide between states suggests the industry remains backlogged by investigations into the foreclosure process.
