Today, I'm talking to you about a serious problem.
If you're an owner of a property,
you may have come to me or another lawyer in 2019 because you bought the property and the prior owners haven't moved and you want to get them out.
Or maybe someone is a squatter, never paid you any rent.
Or maybe the tenant had taken in a roommate and the tenant moved out and the roommate doesn't want to leave.
These are all situations under the real property actions and proceedings law section 713
that say there is no landlord tenant relationship.
A 10 day notice can be served because you've never taken any rent and you can start a court case to get them out.
The problem is New York State and the legislature and the governor and the judiciary.
It's amazing when you have all three branches of government hardly working for you.
Nothing gets done.
That's where I come in.
I started an action for you back in 2019
to get that squatter out, not a tenant, and we filed your holdover case.
But nothing happened.
We served covid notices as required by the court.
Still no answer from anybody.
So what's supposed to happen in New York City?
You can't win by default.
You have to file what's called a motion for an Inquest.
Well, in the past two weeks, I filed 12 motions for Inquest and they've all been rejected by the court.
And when I contacted the chief judge,
I hear, well, you know, we're working on a plan.
Well, you know what, a human being can survive only about three minutes without oxygen.
And if you're the owner of a building and you can't move into your house because you're paying two mortgages, you're drowning, you're suffocating, and someone has to hear you.
I hear you.
So what I want you to do is if you fit

I'm going to be filing what are called Article 78 cases in Supreme Court and whatever court's necessary to force the housing court to accept papers and to hear cases.
Because if you own a property and you can't get into your property, you're entitled to be heard.
It's not that hard, is it?
Yet the judiciary, the governor and the legislature don't get it, all they want to talk about is cancel rent, cancel.
This isn't about rent.
These people aren't even tenants.
