What a way to start the New Year 2019. Jury Trial in Burleigh County (Bismarck). Trial has been continued multiple times last year. Adult estranged daughter in drunken state called Dad's work place, local cab company, and demanded dad be dispatched to pick her up. Dad responds while on duty. Has to wait for daughter to find her purse, phone and keys inside friends house, without success. Daughter is very drunk, verbally abusive and began to hit on him hindering his ability to drive. Dad pulls over cab and tells her to get out. She does and starts walking to her destination a block away. At mid stream she changes her mind charges back to driver's side of cab and starts yanking on the driver's side window while yelling and screaming. Dad attempts to get out of the cab and daughter pushes him against the cab. Dad removes expensive dental plates that he fears will be damaged. She continues try ate and attack. Dad grabs at her she goes to the ground and he places his hand on her neck and puts his knee across her chest until she calms down. She calms down. Dad gets up and drives off. Daughter walks to friends house, makes phone calls to unknown people and later calls police. Cops come out and see one small scrape on elbow, one small scratch on neck and dirt on sweat pants. Photos taken and report lists "minor" scratch and scrape. Cops proceed to dad's house arrest him, photograph the injury to leg where car door was slammed on him.
Jury hears from daughter who can't remember a thing about what she did, two cops testified that they take down people out of control all the time and scrap, scratch and dirty clothes are consistent with their tactics and training. Also daughter never told them about leaving and coming back to the cab to continue her verbal and physical attack. Dad testified and told entire story.
Jury returned NOT GUILTY verdict in about an hour!
