I disposed of two more restraining order cases yesterday, in Manteca Court.

People are filing restraining orders at a record pace:
More civil harassment restraining orders.
More domestic violence restraining orders.
More restraining orders following criminal protective orders.

Be aware, different types of restraining orders have different procedural rules and different standards of proof.
Not for amateurs.

I just won another Restraining Order case. It is extra work for judges, but I requested a Statement of Decision, which outlines factual findings by the judge. This is an important strategy if the problems between the parties appear to be ongoing, or if a related matter may arise. Judge Freeland wrote an excellent Statement of Decision which will help my client in another case between the parties.

In the past two years, I have handled somewhere between 20-30 retraining order cases. I have both prosecuted and defended cases for my clients. I have only lost one, and that was because my client admitted to committing certain crimes before I came into the case.

The California Bar Journal, November 2015 issue, reports:

18 Disbarments from the practice of law.
23 Suspensions from the practice of law.

The vast majority of the disbarments were for attorneys located in Southern California.

The license suspensions from legal practice were split fairly evenly between attorneys located in Northern and Southern California.

The most commonly disciplinary reasons were for substance abuse/ alcohol related crimes; failure to handle matters competently; and failure to properly complete and report the required coursework for continuing education. More serious incidents occurred, but were less common.

Always check out attorneys before hiring them to be sure they are currently licensed to practice law.
