The Christmas season is here. It’s the time for garland and red ribbon all around, kiddos taking pictures with Santa, shopping malls crowded, and holiday parties everywhere. Most importantly, it’s a time for family. In the coming days, you will be gathering around your loved ones.

What is that old cliché we’ve always heard? “There are only two guarantees in life…death and taxes.” Well, we know we have to pay our taxes, but what happens after we die? Or what happens after a loved one dies? All our lives we accumulate things such as houses, money, vehicles, all kinds of personal property. But what happens to all of that after we die?

Often times when loved ones pass away, they still own property in their respective estates. Many times this property is land, a house, minerals, banking accounts, etc. If there was no appropriate planning strategy in place before the respective loved one’s death, their property will have to be administered by the court. This is commonly known as “probate.”

As mentioned above, probate will be required to occur in the event there were no appropriate planning tools in play such as assets being funded to a revocable or irrevocable trust, property be titled in joint tenancy, or there be a payable or transfer on death designated. A common misconception is that if the loved one left behind a last will and testament then their property does not have to go through probate. This is incorrect. The will only designates who the property goes to and if there are any heirs excluded from receiving property.

Probate is a state law procedure administered under the supervision of the district court. A petition will have to be filed, inventory and accounting of the estate will have to be prepared, filed and delivered to the judge, the appointed personal representative will have to appear at court hearings. The laws and rules of probate procedure is very comprehensive and it takes an experienced attorney to guide one through the muck for an efficient result.

The old legal lingo we hear is Estate Planning. Well, what is that? Here, we call it Life Planning™. What we do is plan for what we want to happen after a life event strikes, such as disability, death. Where will my money and house go? Who will take care of my things? Who will take care of my children? How will my things be divided between my children and my step-children? Who will take care of me if I am incapacitated? Will all of this have to go to court? Will my children’s inheritance be protected from divorce? Will my children have to pay inheritance tax? These are the common questions we all face as we walk through life.

Our goal here is to put our clients’ minds at ease when they approach us with these questions. Clients are advised not to determine whether they need a trust or a will, they are advised to bring the questions, bring whatever they are concerned about, and we will fit the right tool to address each concern.

One of the most common legal matters that people face occurs after the death of a loved one. Families are often left to deal with the house, bank accounts, and all kinds of other assets. At that time you ask, “Did they have a trust?” “Did they leave a will?” “Did they leave anything at all?”

According to Oklahoma law, if the decedent had not formed an estate plan by way of a trust prior to their death, his/her assets will have to be passed to their heirs by way of probate (having a last will and testament) or estate administration (not having a will). These are judicial proceedings in which the court oversees the final closing and distribution of the estate. During the proceedings and prior to outright distribution the heirs have to be made known to the court. Then the decedent’s creditors have to be determined and allowed an opportunity to file a claim on the estate. All property is to be collected and final tax returns are to be filed. After all of this, whatever is left over can finally be distributed to the family.

What is this thing we call “estate planning”? You hear it being talked about but many people, if not most, don’t know what estate planning is, or the purposes of the estate planning lawyer. Most people know what criminal lawyers and divorce lawyers do, but not what estate planning lawyers do.

How about this? Let’s get rid of the legal lingo and make this real simple. What I do is work with my clients in dealing with their property/properties, which may consist of their homes, money, business, farms, retirement, fi****ms, and practically any and all things they have ownership in. Their property is their “stuff.” My job is to work with clients in dealing with their stuff, for now and in the future.

“So Bryon, what are the things they call ‘wills,’ ‘trusts,’ ‘power-of-attorney,’ what are those things?” My answer is “those things are merely tools in dealing with what you want to do with your property, now and in the future.” When I meet with new clients, we first discuss what their property consists of and what concerns/issues/matters/interests they have regarding it. Later we talk about the tools.

Common concerns that clients have consist of dealing with their property after their death and avoid probate, after death distributions to special needs children, protection of children’s inheritance, giving power to someone over property upon disability/incapacity, distributions within blended families, etc.

So let’s schedule an appointment and have a discussion on what to do with your property. If you own a business, retirement accounts, rental property, or if you only own your home and bank accounts, let’s talk about what we can do for you and your property for now and in the future. Don’t worry about what tools to use, we will decide on that together.

Blended families are a common occurance; spouses marry having children from previous relationships. All is good while you and your spouse are alive and well, however the disposition of your money and assets upon your disability/death becomes uncertain without planning ahead of time, and this often leads to catastrophic family feuds.
