The U.S. ban on Canadian alcohol is now in effect, but the impact isn’t as straightforward as it may seem.

The ban applies to certain Canadian-produced b**r, w**e and spirits entering the U.S. However, products shipped in bulk for U.S. bottling can qualify for an exemption. That means brands such as Crown Royal may continue to be available, while products produced and packaged entirely in Canada could face supply disruptions.

For hospitality operators, distributors and retailers, understanding how these exemptions apply is important as the new rules take effect.

Could home distilling be headed for a major legal change?

Federal law currently prohibits individuals from producing distilled spirits at home for personal consumption. Two cases before the U.S. Supreme Court challenge that prohibition, raising questions about the limits of Congress’s taxing and commerce powers.

The cases involve a longstanding federal restriction on home production of spirits and a disagreement between federal appeals courts over whether the restriction is constitutional. The Supreme Court is scheduled to consider the petitions on October 9.

For the distilled spirits industry, it’s a case worth watching as the Court considers the reach of federal alcohol regulation.
