Do you want your least favorite relative raising your kids?

A last will and testament allows you to designate who should be the legal guardian of your minor children if you pass away. If you don’t have a will in Florida, the court will have to decide who has the legal right to be the guardian of your children. Maybe you have relatives you would not entrust with the care of your kids. To make sure your children are raisedin a loving home by people you trust, it is best to prepare a last will and testament ahead of time.

Does a Will expire?

Wills do not have an expiration date, so a will that is properly drafted and executed remains valid until it is revoked.

As your family grows and changes with new births, marriages, and deaths, however, your wishes may change, altering your list of beneficiaries. Years ago, when your children were all very young, an equal division of assets seemed fair. Now, your older children might be independent and thriving with families of their own, and it’s your younger children that might need more help from your estate to come into adulthood if you were to pass away unexpectedly.

When a person dies without a will, and they owned property or accounts only in their name, who inherits?

The law calls this situation an “intestate estate.” In Florida, the probate judge will apply the Florida statutes to divide the assets and distribute them among the surviving spouse and/or closest family members, depending on the deceased person’s family tree. This intestate succession is the only option when there is no will and could result in less-than-ideal situations, such as an 18-year-old inheriting a home or a significant amount of money, both of which he or she may not yet be mature enough to handle.
