I had a question about signer compentency today.
Can I notarize if the signer isn't fully 'with it'? (The big one)
“My dad is in the hospital. Can you notarize his power of attorney?”
It depends on one thing: him. Idaho law lets me refuse a notarization if I'm not satisfied the signer is competent, has the capacity to sign, and is signing knowingly and voluntarily (Idaho Code § 51-108).
When I arrive, I talk with the signer, not just the family. If they can tell me who they are, what the document is, and that they want to sign it, we're usually good. If they're heavily medicated, drowsy, or confused, I'll respectfully reschedule. That protects YOUR family, because a notarization done wrong can be challenged later.
Tip: schedule for the time of day your loved one is most alert, often mornings or right before a medication dose.
