Longtime Nashville Attorney Bart Durham, who has entered the local cultural zeitgeist with all of his advertising over the years, has passed away. He was 89 years old.

His law firm sent us a lengthy obituary, but this part stood out in particular, "Unwilling to retire because of his love for work, and for fear of getting bored, Bart continued assisting with work at
his firm until his passing."

His funeral is set for Tuesday April 16th at noon, at Woodmont Christian Church.

The Tennessee Court of Appeals delivered another victory for homeowners and a defeat to overreaching HOA's this week. In Driftwood Estates Property Owners Association, Inc. et al vs. John Sweeney et al, No. E2023-00463-COA-R3-CV, (Tenn. Ct. App. March 14, 2024), an HOA tried to rope in a parcel to their restrictions that was not part of the original declaration's covered parcels. The trial court had already dismissed the HOA's claim, but the HOA zealously appealed to the Court of Appeals, and lost again. I wouldn't be surprised if the HOA doesn't let it go this time and tries to appeal to the Tennessee Supreme Court, but the opinion of the Court of Appeals was well reasoned, and I suspect all the HOA will do in an appeal to the state supreme court will be to waste even more of their duespayers' money and provide even more case precedent for homeowners. When you get too greedy, too overreaching, and go too far, you risk an adverse legal consequence. And HOA's have indeed become too greedy, too overreaching, and have gone too far. Great opinion from the Tennessee Court of Appeals in this case.

Interesting case. They came into his home to serve a warrant but are saying that he invaded THEIR privacy. Is he not able to film within his own home when most likely he was filming officers who themselves were wearing body cams? Any legal rulings that come out of the case could apply to other public service professions--teachers who are videotaped by their students in class without their consent or the consent of the school administration, e.g. Can the teacher then sue the student?

Because of the real estate market in many areas, it is not as feasible to navigate a Chapter 7 and keep your home as it was in the aftermath of the 2008 recession, when homes had little or no equity. Most of the growth that has been seen in bankruptcy filings are Chapter 13's. I predict Chapter 13's will again be the bankruptcy leader in 2023.
