I’m often asked, “What is the purpose of a notary?” We all know notaries are needed for certain legal documents, but why?
Many people think a notary “legitimizes” a document or makes it “more legal,” but that’s not quite accurate. In reality, a notary plays a critical role in legal transactions by confirming the identity, willingness, and awareness of the parties involved. This process helps prevent forgery and fraud.
Not only does this provide immediate protection, but it also creates long-term legal records that courts and institutions can rely on.
It’s also important to understand what a notary does not do. Notaries are not attorneys and must be careful not to provide legal advice or explain documents. This helps maintain impartiality and avoids the unauthorized practice of law.
Together, these responsibilities and boundaries are what make notarizations a trusted safeguard in important transactions.
