Today I am ecstatic. Last August myself and co-counsel J. Andrew Douglas won a six-day bench trial in a trusts and estates and real property case. The losing parties appealed. Their counsel failed to timely file the record on appeal and then filed a motion for relief from default and extension of time. Such motions are routinely granted. However, I filed a hard-hitting opposition, and today the Court of Appeals issued a final order accepting my opposition and dismissed the appeal at the outset. My client’s six-year-long expensive litigation nightmare is now over. Mazel tov to my client. This Tuesday is starting out well.
