Trenk Isabel Siddiqi & Shahdanian employment attorney Valentina Scirica has a timely reminder for New Jersey employers using AI to make workplace decisions: a decision does not escape discrimination law because an algorithm helped make it.

In her latest New Jersey Law Journal article, Valentina examines how AI tools used to screen applicants, evaluate interviews, monitor performance and inform promotions can create legal exposure under existing federal and state law.

A tool can produce discriminatory results without being designed to discriminate, and a vendor’s promise that its product is “bias-free” does not relieve an employer of responsibility for how it is used.

Valentina's advice starts with understanding where AI is already influencing decisions across the organization.

From there, employers should ask:

💠What information does the tool evaluate, and is it relevant to the job?

💠Has it been tested for different outcomes among protected groups?

💠Can a person meaningfully question or override its recommendations?

💠How can applicants and employees request an accommodation or raise a concern?

💠What records will show how a decision was actually made?

While New Jersey lawmakers consider more specific requirements for workplace AI, Valentina explains why employers have reason to address these questions now, under the laws already in effect.

Together, the ladies assembled care kits for first responders across New Jersey, joining fellow volunteers in turning remembrance into meaningful action on the 25th anniversary of September 11.

We thank Jersey Cares for creating this opportunity to honor those lost and injured through unity, empathy and service to others.

It was a perfect summer evening for baseball, conversation, and connecting with colleagues from across New Jersey’s legal community.

Trenk Isabel Siddiqi & Shahdanian pauses to remember the lives lost on September 11, 2001, and to honor the families, friends, colleagues, and communities whose lives were forever changed.

We remember the courage of the first responders who ran toward danger, the selflessness of ordinary people who helped one another in extraordinary circumstances, and the countless acts of service and compassion that followed in the days, months, and years afterward.

Twenty-five years later, the passage of time has not diminished the significance of that day - or our responsibility to remember.

We honor those we lost, those who served, and those who continue to carry their memory forward.

We will never forget.
