A proposed class of financial advisers asked a California federal court Thursday for preliminary approval of a $9.5 million settlement that Wells Fargo has agreed to pay to end an action alleging the bank did not properly reimburse business expenses or pay commissions on time.

February 2016 Case Updates

Duran v. US Bank – overtime case on behalf of branch-based business bankers: Following remand from the Supreme Court, the parties filed briefs on the issue of whether the case should re-certified as a class action. In support of that effort, Plaintiffs had hired Dr. Jon A. Krosnick of Stanford University to conduct a survey of class members on relevant issues. The results of the survey were overwhelmingly in support of Plaintiff’s case. On January 20, 2016 the Court issued an order finding that Plaintiffs’ “statistical survey evidence may be used in this case to ‘plug the evidentiary hole’ the Supreme Court identified in its opinion…” The Court also stated that “the remaining and much more complicated question of whether THIS SURVEY achieves that goal remains outstanding.” The Court also reiterated its intention to appoint a neutral third party expert to assist the Court in an eventual evidentiary hearing on the issues of Plaintiffs’ survey and the analysis of that survey data. Both sides have submitted three candidates and the Court is in the process of choosing one. Once that has been done, the parties anticipate a hearing in April 2016 to determine whether the case should be re-certified as a class action.

Tsyn v. Wells Fargo Advisors – case for unreimbursed business expenses, unlawful deductions and overtime compensation on behalf of Financial Advisors nationwide and in California: Plaintiffs have filed a motion for conditional certification of a nationwide class of WFA financial advisors seeking overtime compensation and Defendant filed a motion for summary judgment against two of the named plaintiffs. Those motions are under submission. A privacy notice has been sent to all California FAs in both PCG and WBS informing them of the case. Plaintiffs will continue to gather evidence in support of their claims related to unreimbursed business expenses and unlawful deductions, e.g., sales associates allocations, trade errors, and internal referral fees.

Erami v. JP Morgan Chase Bank – overtime and meal/rest case on behalf of Assistant Branch Managers in California: The case has been transferred to federal court in Los Angeles and the parties are currently exchanging discovery related to the claims for unpaid overtime compensation and meal and rest breaks that were not provided. Plaintiff will be amending the complaint to add two new class representatives and will continue to prosecute the case on behalf of all California Assistant Branch Managers.

Kibera v. Donovan – personal injury case: This case gathered local news attention when defendant John Donovan engaged in a road rage incident in west Marin with bicycle rider Jonathan Kibera. After causing injury to Kibera with his vehicle, Donovan fled the scene and was subsequently arrested by authorities and charged with two criminal counts. Donovan has plead guilty to reckless driving. The bicyclist, Jonathan Kibera, has brought a civil action against Donovan alleging that Donovan engaged in intentional acts meant to cause harm to the bicyclist Jonathan Kibera.
