What Type of Video Formats Do I Require?
Using the right file format is crucial to get the videos to operate with your trial presentation software. Following types of video file formats are popularly used nowadays to record legal video depositions:

MPEG: This format is PC/Windows compatible and it is perhaps the most often chosen video format.

MP4: This format is compatible with both PC and Mac and the video can be trimmed or edited very easily.

DVD: If you want the complete deposition recorded and placed on a DVD then this is likely to be the format you desire.

Synchronized Copy: This format is applicable in situations where you need the jury to view every word or phrase spoken, line-by-line by a witness in a deposition.

Synchronized DVD: This hybrid format is an aggregation of the above two formats. A synced DVD is compatible with most DVD players using closed subtitles to show what is being spoken by the deponents.

Improved technology means picture in picture video depositions have finally come into their own. There are many reasons why they are so effective, here are three big ones.

1. Deponent is always on camera. Even when visual evidence is presented. Picture in picture video depos use a secondary source, be it an Elmo document camera or a connected laptop to present visual evidence on screen while the depo tech keeps the primary camera focused on the deponent.

2. Easy inclusion of original digital evidence. Sourcing images directly from a laptop means higher quality visual evidence is not compromised by having to point the camera at images printed out on paper, or having to shoot a video playing on a monitor.

3. Capture a witness’ reaction in real-time as they view the evidence. Seeing a witness react their first time watching a surveillance video of a crash can be incredibly impactful.

Juries can see evasive or coached witnesses. Jurors often associate certain behaviors as evidence of untruthfulness. It might be a witness’s long pause before answering a question, or a failure to look at the questioner, or a sideways glance in the direction of defending counsel. Time-stamped deposition transcripts reveal the time gap between the attorney’s question and the deponent’s answer when the attorney reads this information to the jury. The same information has more impact however, when the jury views the video and sees for itself the pause that precedes the deponent’s answer. And a deposition transcript never records “body language” or other non-verbal deponent behavior during the deposition. With a video deposition, the jury sees everything.

Present a Strong Witness Who Cannot be in the Courtroom
There are many reasons why witnesses may not be able to make it into court for trial. They may have travel restrictions or medical conditions that make their physical presence impossible—a witness may even pass away before their court date. However, if an attorney knows they have a strong witness that can benefit their case, they also know it is imperative for the jury to see the witness. Video footage from a deposition allows the jury to watch the witness while you present their testimony. It’s especially important to get witnesses on video if there’s a chance they’ll die before trial—otherwise, the nonverbal components of their delivery will be lost forever. Even though having a witness in court is sometimes the best option, a video transcript of deposition testimony is definitely preferable to a written transcript.
