Yesterday in criminal court in Knox County, we had a sentencing hearing on a revocation where our client was charged with a 3rd Violation of Probation (VOP). This 3rd VOP was issued on March 17, 2022. However, this same VOP warrant was not served until June 27, 2026, so our client was deemed to have absconded for more than 4 years and 3 months.

While practicing criminal defense for 12 years, I don’t recall any client that has absconded for that length of time. The Judge also said he is not sure anyone has absconded for that long that he can recall. But, I was able to discuss the details of the case with the professionals that interviewed and assessed my client and also discovered the mental health and medical issues my client has dealt with for years. After thorough preparation and delivering my client’s personal story to the Judge, he agreed to give my client the help she desired and desperately needs, and he placed her back on probation under the care and supervision of the Daily Reporting Center (DRC).

I would like to personally thank Ms. Samantha Monday for her valuable insight and professional knowledge in assessing my client in this matter. Ms. Monday constantly provides invaluable help to so many individuals in our community, and she assists our courts and Judges to make key decisions that impact and change people’s lives on a daily basis. I am grateful to have the opportunity to help people get an extra chance to take control of their lives. Once they get that chance, the onus is on them to take advantage of the opportunity. Positivity is a powerful thing when applied properly.
