The problem with this is that once the reading is not above .08%, the officer’s mindset is let’s see what else might possibly be in the system, so let’s get a blood sample.

That’s also how the DAs view it, as well. If you don’t have an alcohol level to support prosecution, let’s order a toxicology test to see what else we may find that can apply leverage to get a plea, regardless whether the officer suspected any substance impairment or not.

The toxicology tests are what cause the backlog for the TBI and are currently taking around 22 weeks to process. So, no real news of improvement here – Simply deflection.

The Tennessee Highway Patrol is reversing its stance on breathalyzers after years of refusing to use them during field sobriety tests.

These Standardized Field Sobriety Tests are extremely difficult to perform and requires a skilled athlete that already knows the instructions and the clues officers are looking for to use against them (that they do not share) in order to pass. No person should ever consent to taking these tests as they are completely optional to take.

Pro Tip: You should probably describe any physical injuries or issues that you may have as a supporting reason why you decline these tests for a subsequent jury to understand why you will not allow an officer to use your physical ailments against you to imply you are impaired when you are not.

It’s time these quota-filling Troopers and other like Officers be held accountable for causing destructive damage to innocent citizens’ lives. A dismissal after enduring false arrest, being humiliated and taken to jail while losing your liberty and freedom, and expending thousands of dollars and voluminous hours defending yourself is nowhere near enough recompense for an officer using the system to further his career at the expense of innocent citizens.

The law enforcement officer admitted that he had no idea what this man was doing and he had no idea whether he had weapons. That is enough evidence to show he violated this man’s rights by illegally seizing him and frisking him. Officers need a refresher course as to the requirements for a Terry frisk.
