MYTH: A notary can notarize their own signature.

FACT: A notary cannot notarize their own signature. A notary also should not perform a notarization when they are a party to the document or would receive a direct or indirect financial benefit from it. That would not be very “impartial,” would it? A proper notarization requires an unbiased notary who can independently verify the signer and complete the notarial act.

MYTH: Anyone can simply sign for a person who is physically unable to sign.

FACT: Arkansas provides special procedures for someone who cannot physically sign or
make a mark—but it is not as simple as letting another person sign.

Specific instructions, disinterested witnesses, the signer’s direction, and special wording may be
required. This is one reason it helps to contact your notary before the appointment. We can discuss what people may need to be present so nobody makes an unnecessary trip!

MYTH: A notary can tell you which document you need or explain what you should legally do.

FACT: Unless the notary is also a licensed attorney, a notary cannot provide legal advice, prepare legal documents for you, or tell you which legal option to choose.

I’m happy to explain the notarization process—but legal decisions must come from you, the document’s receiving agency, or a qualified attorney.

Attorney? Nope—and I’ll never pretend to be one!

MYTH: A notary checks a document and guarantees that everything written in it is correct.

FACT: A notary is not responsible for approving the contents of your document. A notary’s primary responsibilities include identifying the signer, observing the notarization, and completing the notarial certificate correctly.

In other words, I check the signer—not every sentence!

FACT: A notary does not approve a document or determine whether it is legally valid. My job is to verify the signer’s identity, confirm that the signer is acting willingly, and properly complete the requested notarization.

Think of a notary as an official, impartial witness—not the judge, attorney, or document police!
