Had a great time discussing the Supreme Court’s blockbuster February 20, 2026 decision on CGTN America Global Business with Sally Ayhan.

As much as all 10K+ of us were logged in to SCOTUSblog the morning on Feb. 20 waiting with bated breath to see if today was the day, and the almost audible gasp heard through the live chat when it was announced that the Court was rendering its tariffs decision, the majority opinion was actually quite measured.

It was not a disappointment by any stretch of the imagination. But it was measured. And very much protective of the Constitution and the intent of the Founding Fathers as it pertained to the power of the purse.

One of the most important lessons I learned as General Counsel is the ability to peek around corners, because by the time data confirms a problem, the business impact has usually already occurred.

When new tariffs were announced last year, I didn’t wait for economic reports. I looked at how contracts and shipment terms actually allocate liability, and it was clear that U.S. importers would bear most of the cost.

I discussed this in a posted video reel ahead of the Supreme Court Nov. 5, 2025 oral arguments, and then later published an article in Jurist.org examining how a foreign-facing-terrorist-defunding statute (IEEPA) was being used to impose financial burdens primarily on Americans.

Three months later, on Feb. 12, 2026, the Federal Reserve issued a report that essentially confirmed the same. It found that over 90% of tariff costs landed on American firms and consumers. On February 13, 2026, China Global Television Network ask me to walk through why that result was predictable long before the numbers caught up (CGTN interview link below).

Why is the timeline important? Foresight is one of a GC’s most valuable tools. When businesses can anticipate how legal and regulatory shifts translate into real operational impact, they’re able to manage risk earlier and far more proactively.

This is that quiet week at the end of the year. The celebrations are winding down, things feel a little slower, and many of us are scrolling, reflecting, and thinking about what we want to do differently in 2026.

For companies, this might be a good moment for an antitrust check-up.
The antitrust rules themselves haven’t changed much, but the tools have.

Data platforms, benchmarking services, and pricing technology are now part of everyday business, some of which were at play in recent antitrust cases, such as, the RealPage litigation (preliminarily approved settlement in November 2025), Tyson's settlement in the beef-price-fixing action (October 2025), and DOJ’s Agri Stats settlement (October 2025).

At the same time, EO 14364 announced the Administration's crackdown on anticompetitive conduct in the food supply chain (Dec. 6, 2025), focusing on foreign-owned or foreign-controlled entities participating in the U.S. food supply chain.

Suffice to say, there's a lot going on in the antitrust world. Now might be a good time to think about a compliance checkup in the New Year.
