BASIC STEPS OF A MOTOR VEHICLE ACCIDENT (MVA) CASE IN THE U.S.
Many people who are involved in a car accident are not sure where to start or what they should do first.
In reality, an MVA case in the U.S. goes through several important steps, and mistakes made at the beginning can delay the process or affect the amount of compensation.
Below are the basic steps of a typical MVA case:
1. Case Intake
The attorney reviews the accident details, insurance information, police report, and injuries to evaluate the case.
2. Sign with an Attorney
After signing the retainer agreement, the law office will communicate with the insurance company on your behalf.
3. Medical Treatment & Records Collection
Medical records, bills, MRI, X-ray, therapy notes, and diagnosis reports are essential for your claim.
4. Evidence Collection
Police report, photos, witness statements, insurance information, and repair estimates are gathered.
5. Demand Package
Once treatment is stable, the attorney prepares a demand letter requesting compensation from the insurance company.
6. Negotiation with Insurance
Most cases are resolved during the negotiation stage.
7. Lawsuit (if necessary)
If the insurance company does not offer a fair settlement, the case may be filed in court.
8. Settlement & Compensation
After an agreement is reached, the insurance company issues payment, expenses are deducted, and the client receives the remaining amount.
An MVA case can take time, but with proper guidance from the beginning, the process can be much smoother and more organized.
